ORDINANCE2003- 75 AN ORDINANCE OF THE CITY COUNCIL OF THE CiTY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZON!NG A 0.735 ACRE OF PROPERTY LOCATED AT 1220 IH-35 SOUTH AND 1201 MARSHALL STREET FROM "C" COMMERCIAL DISTRICT TO "C-2" HEAVY COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On September 23, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "C" Commercial District to "C-2" Heavy Commercial District for a 0.735 acre tract of property located at 1220 IH- 35 South and 1201 Marshall Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on September 23, 2003 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Councii held a public headng on the 8th 2003, regarding the request. day of December 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "C" Commercial District to "C-2" Heavy Commercial District: Street address: 1220 IH-35 South and 1201 Marshall Street. Size: 0.735 acres. Legal description: A portion of Block 43, Victory Gardens No. 2 Addition, a metes and bounds description of which is attached as Exhibit A. Deed or plat reference: Volume 153, page 484-485, Hays County Deed Records. 117. SECTION 2. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
