ORDINANCE NO. 2010-6 <br />• <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "LDR" LOW DENSITY <br />RESIDENTIAL TO "MDR" MEDIUM DENSITY RESIDENTIAL FOR <br />A TRACT OF LAND LOCATED AT 1105 HILLYER STREET; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "SF-6" SINGLE FAMILY <br />RESIDENTIAL DISTRICT TO "DR" DUPLEX RESTRICTED <br />RESIDENTIAL DISTRICT (MEDIUM DENSITY); AND INCLUDING <br />PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On January 12, 2010, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "LDR" Low Density Residential to "MDR" Medium Density <br />Residential, and a concurrent request to change the zoning from "SF-6" Single Family <br />Residential District to "DR" Duplex Restricted Residential District (Medium Density), for a tract <br />of land located 1105 Hillyer Street. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />• considered and voted to approve the requests on January 12, 2010, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on February 2, 2010 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "LDR" <br />Low Density Residential to "MDR" Medium Density Residential: <br />Street address: 1105 Hillyer Street <br />0 Legal description: Lot 557, Block 42, Westover Addition
