6. Amend Section 6.08 regarding the holding of elections after the certification of a recall <br />petition: <br /> <br />Sec. 6.08. Recall election. <br /> <br />The provisions regulating examination, certification and amendment of initiative petitions <br />shall apply to recall petitions. If the petition is certified by the city clerk to be sufficient, the <br />council shall order and hold an election to determine whether such officer shall be recalled. <br />The election shall be held on the date next authorized by state law for municipal elections <br />which is at least 62 30 days after certification of the petition calling for the recall election. <br /> <br />Rationale: The proposed change will keep the Charter current with State law. The State Legislature <br />in 2003 revised the deadline in the State Election Code for calling a local election to 62 days prior to <br />the election date. <br /> <br />7. Amend Section 7.0'1 regarding the composition of the planning and zoning commission and <br />qualifications for its members as follows: <br /> <br />Sec. 7,01. Planning and zoning commission. <br /> <br />_(9_) A city planning and zoning commission is established. The commission shall consist of <br />nine members appointed for staggered three-year terms. Commission members shall be <br />appointed by the council and serve without compensation. <br /> <br />(b) To be eligible for appointment to the commission, eight of the commission members <br />must have resided and owned real property in the city for a period of three years before the <br />date of appointment, and the remaining member must have resided and owned real property <br />in the city's extraterritorial jurisdiction for a period of three years before the date of <br />appointment. To be eligible for continued service on the commission, the commission <br />members appointed as city residents must maintain residence in the city, and the commission <br />member appointed as an extraterritorial jurisdiction resident must maintain residence in the <br />extraterritorial jurisdiction. <br /> <br />(c) To be eligible for election and continued service as chair of the commission, <br /> <br />commission member must reside in the city. <br /> <br />(d) The council shall establish, by ordinance, the .... ~,~ <br />..... ; ..... fo an~ month in which appointments are made, and the month in which terms of <br />office o£members c, fthe con.miss'ion commence.
