Regular Meeting <br /> <br />January 26, 2004 <br /> <br /> 183. <br />Page 7 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE APPOINTMENT OF OF THE LAW FIRM OF <br /> TO SERVE AS SPECIAL COUNSEL TO THE ETHICS REVIEW <br />COMMISSION; AUTHORIZING THE CITY ATTORNEY TO NEGOTIATE AN AGREEMENT <br />FOR THESE SERVICES AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. Thomaides <br />seconded the motion. Mr. Thomaides moved to amend the Resolution by <br />hiring Barney Knight with the law firm of Barney Knight and Associates, <br /> <br />and Mr. Mihalkanin seconded the motion. <br />was recorded: <br /> <br />On roll call the following vote <br /> <br />AYE: <br /> <br />Thomaides, Mihalkanin, Montoya and Diaz. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Narvaiz and Habingreither. <br /> <br />On roll call for adoption of the Resolution, the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Thomaides, Mihalkanin, Montoya and Diaz. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Narvaiz and Habingreither. <br /> <br />Mayor Habingreither introduced for consideration approval of minutes of <br />the Regular Meeting held January 12, 2004, approval of three Ordinances on <br />second reading, adoption of one Ordinance on third and final reading, <br />adoption of eight Resolutions, approval of Change Order No. 2 in the <br />amount of $35,623.30 with Texas Road & Utilities, Inc. regarding the <br />IH35/Fairlawn Force Main and Intercept or Improvements project, and <br />approval of General Fund Contingency Funds in the amount of $8,000.00 to <br />clean property that has not been maintained according to City Code-Chapter <br />34, on consensus. Mr. Montoya moved for approval of minutes of the <br />Regular Meeting held January 12, 2004, approval of three Ordinances on <br />second reading, adoption of one Ordinance on third and final reading, <br />adoption of eight Resolutions, approval of Change Order No. 2 in the <br />amount of $35,623.30 with Texas Road & Utilities, Inc. regarding the <br />IH35/Fairlawn Force Main and Intercept or Improvements Project, and <br />approval of General Fund Contingency Funds in the amount of $8,000.00 to <br />clean property that has not been maintained according to City Code-Chapter <br />34,~and Mr. Thomaides seconded the motion, which passed unanimously(Mayor <br />Habingreither and Mr. Mihalkanin abstaining from Item 19, adoption of an <br />Ordinance regarding Texas State University-San Marcos).
