MULTI-FAMILY RECYCLING SERVICES <br />PILOT PROGRAM CONTRACT <br />This Contract is made on this the 16th day of February, 2010 between the City of San Marcos, <br />Texas (the "City"), 630 East Hopkins, San Marcos, Texas 78666 and Texas Disposal Systems, Inc. <br />(the ("Contractor") P.O. Box 17126, Austin, Texas 78760-7126 for the provision of a Multi-Family <br />Recycling Services Pilot Program (the "Program"). <br />The City and the Contractor agree as follows: <br />ARTICLE 1 <br />CONTRACTOR'S SERVICES AND RESPONSIBILITIES <br />Section 1.1 Standards of Performance <br />1.1.1 The Contractor is responsible for the provision of multi-family recycling collection for the <br />Program locations and for the marketing and disposal of collected materials in accordance with the <br />terms and conditions of this Contract in a good and workmanlike manner (the "Services"). Services <br />includes furnishing all labor, equipment, tools, materials, insurance, supervision, and all other items <br />necessary to complete the work as specified. No work under this Contract will be subcontracted by <br />the Contractor without prior written approval from the City. Any subcontracts will be in writing and <br />will be subject to each provision of this Contract. <br />1.1.2 Upon execution of this Contract by both the City and the Contractor, the Contractor will <br />proceed with the Program on a weekly basis for a six month period at the following locations in San <br />Marcos, Texas. The City will have sole discretion regarding which of the following locations are <br />designated for single-stream or source-separated recycling service: <br />a) Garden Oaks, 1115 N. LBJ <br />b) Bishop Corner, 1409 Bishop <br />c) Chestnut Place, 1021 Chestnut <br />d) Sundance Apartments, 400 Linda <br />e) B&H Mobile Home Park, 1716 Hotheinz <br />f) CM Allen Homes, 795 River Road <br />g) Mariposa, 2600 Hunter <br />h) The Sanctuary Lofts, 350 North <br />The Program will allow the City to gather information and make an informed decision as to whether <br />to provide Services on a larger scale. All services will be performed in accordance with Section 1.3.1 <br />of this Contract. <br />1.1.3 The Contractor certifies that it has fully acquainted itself with all conditions related to this <br />Contract and will complete the Services in and under any conditions it may encounter or create, <br />[1]
