191. <br /> <br />RESOLUTION NO. 2004- 13 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE APPOINTMENT OF <br />BARNEY KNIGHT OF THE LAW FIRM OF BARNEY KNIGHT & <br />ASSOCIATES TO SERVE AS SPECIAL COUNSEL TO THE <br />ETHICS REVIEW COMMISSION; AUTHORIZING THE CITY <br />ATTORNEY TO NEGOTIATE AN AGREEMENT FOR THESE <br />SERVICES AND AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT; AND DECLARING AN <br />EFFECTiVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. The Ethics Review Commission, at its December 30, 2003 meeting, requested that the <br />City Council approve the hiring of an outside attorney to serve as special counsel to the Commission <br />for a pending complaint against Mayor Habingreither and Council Member Taylor. <br /> <br /> 2. The City Council wishes to engage Barney Knight of the law firm of Barney Knight & <br />Associates to serve as legal counsel to the Ethics Review Commission for matters involving City <br />Council Members or City Council candidates. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> PART 1. The appointment of Barney Knight of the law firm of Barney Knight & Associates <br />to serve as special counsel to the Ethics Review Commission for issues involving City Council <br />Members or City Council candidates is approved. <br /> <br /> PART 2. The City Attorney, Mark B. Taylor, is authorized to negotiate an agreement with <br />the attorney named in Part 1 for these services on an as-needed basis, and the City Manager, Dan <br />O'Leary, is authorized to execute the agreement on behalf of the City. <br /> <br />PART 3.
