Regular Meeting February 9, 2004 <br />AYE: Narvaiz, Thomaides, Montoya and Diaz. <br /> <br /> 209. <br />Page 7 <br /> <br />NAY: <br /> <br />Mihalkanin (On roll call Mr. Mihalkanin originally passed when <br />his name was called. When roll call was completed and his name <br />was called again, he voted nay). <br /> <br />ABSTAIN: Habingreither and Taylor. <br /> <br />For the Ordinance to be adopted on emergency would require five votes of <br />approval. The Ordinance received four votes of approval, therefore, was <br />approved on first reading and will be considered by the council at two <br />additional readings. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MAi{COS CITY CODE BY DESIGNATING THE ALLEYS BOUNDED BY HOPKINS <br />STREET, HUTCHISON STREET, N. LBJ DRIVE AND GUADALUPE STREET AS ONE- <br />WAY STREETS; INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Narvaiz moved to approve the Ordinance on first reading and Mr. <br />Thomaides seconded the motion. Mr. O'Leary stated these proposals were <br />recommended by the Main Street Advisory Board and the Downtown <br />Association. Mr. Thomaides stated the Council received several support <br />letters from business owners, but the Fire Department has some concerns <br />regarding delivery trucks blocking alleys and driveways. Mr. Mihalkanin <br />encouraged the Council to approve this Ordinance on first reading and to <br />have Staff look at N. LBJ and Guadalupe Street. On roll call the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Mihalkanin and Habingreither. <br /> <br />NAY: <br /> <br />Thomaides, Montoya, Taylor and Diaz. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. <br /> <br />Mayor Habingreither introduced for consideration approval of minutes of <br />the Regular Meeting held January 26, 2004, adoption of three Ordinances on <br />third and final reading, adoption of seven Resolutions, and approval of <br />Change in Services ~2 in the amount of $71,665.00 in connection with the <br />Surface Water Plant Rerating Contract with Alan Plummer Associates Inc., <br />on consensus. The Council removed Item ~15, approval of an Ordinance on <br />third and final reading, to be considered separately. Mr. Montoya moved <br />for approval of minutes of the Regular Meeting held January 26, 2004, <br />adoption of the remaining two Ordinances on third and final reading, <br />adoption of the seven Resolutions and approval of Change in Services ~2 <br />in the amount of $71,665.00 in connection with the Surface Water Plant <br />Rerating Contract with Alan Plummer Associates Inc., and Ms. Narvaiz <br /> <br /> <br />
