255. <br /> <br /> AMENDMENT TO <br /> EASEMENT AND RIGHT-OF-WAY AGREEMENT <br /> <br />STATE OF TEXAS § <br />COUNTY OF HAYS § <br /> This is an Amendment (the "Amendment") to the easement and right-of-way agreement <br />made by and between Joyce Barrett Reasoner and Harry M. Reasoner (the "Reasoners") as <br />Grantors and the City of San Marcos, Texas (the "City") as Grantee (the "Agreement"), recorded <br />in Volume 815, Page 184 of the Hays County Deed Records. The Agreement and this <br />Amendment apply to an area of land out of an 18 acre tract, more or less owned in fee by the <br />Reasoners and situated in the J.M. Veramendi League No. 2, Hays County, Texas (the "Reasoner <br />Tract"). The Reasoner Tract is more particularly described in Volume 548, Page 246 of the <br />Deed Records of Hays County, Texas. Terms defined in the Agreement shall have the same <br />meaning when used in this Amendment. To the extent the Amendment and the Agreement <br />conflict, the Amendment shall control; otherwise, the Agreement shall remain in full force and <br />effect and control the parties' rights and responsibilities in all respects. <br /> <br /> The purpose of this Amendment is to allow for the City's construction of a 24 inch inside <br />diameter wastewater pipeline in the 1.15 Acre Permanent Easement as a replacement for the <br />wastewater pipeline originally instal]ed by the City in the 1.15 Acre Permanent Easement. <br /> <br /> This Amendment shall become effective on the date that it is executed by the City <br />Manager on behalf of the City with authority to do so approved by the San Marcos City Council. <br />Unless expressly amended in this Amendment, all terms and conditions of the Agreement shall <br />remain in full force and effect. <br /> <br /> For and in consideration of Ten and No/100 Dollars ($10.00) and other good and <br />valuable consideration, and the agreement by the City to (1) amend the Wastewater Utility <br /> <br /> <br />
