automatically revert to the Reasoners free and clear of any right, title or interest in the <br /> City six months after the date of the City's notice to the Reasoners for such pipeline, but <br /> in no event later than one year from the date of this Amendment. <br /> Paragraph (4) of the Agreement is amended to read as follows: <br /> <br /> (4) The 1.15 Acre Permanent Easement shall be used solely to construct, <br />maintain, and operate (a) one water pipeline not to exceed 12 inches inside diameter <br />(including connecting pipelines to serve all parts of the Reasoner Tract) for the <br />transmission and distribution of water; and Co) one 24 inch inside diameter wastewater <br />pipeline (including connecting pipelines to serve all parts of the Reasoner Tract). <br />However, if the City is not allowed to serve the Reasoner Tract with water at the time <br />requested by the Reasoners, or their successors or assigns, nevertheless, the City shall <br />grant to the person who is permitted to provide such water service an easement of <br />sufficient width within the 1.15 Acre Permanent Easement, at not cost, for the <br />construction, maintenance, and operation of a water pipeline to provide water service to <br />the Reasoner Tract. <br /> <br />Paragraph (8) of the Agreement is amended to read as follows: <br /> <br /> (8) The construction of the 24 inch inside diameter wastewater pipeline within <br />the 1.15 Acre Permanent Easement shall be completed within one year after the effective <br />date of this Amendment (the "Initial Construction Period"). <br />Paragraph (10) of the Agreement is amended to read as follows: <br /> <br /> (10) The 1.77 Acre Permanent Easement shall be used solely by the City to <br />construct, maintain, repair, and operate a first-class, paved roadway and necessary <br />drainage for the roadway, and to construct and maintain four curb cuts, a minimum width <br />of 25 feet, to access the Reasoner Tract.
