automatically revert to the Reasoners free and clear of any right, title or interest in the City six months after the date of the City's notice to the Reasoners for such pipeline, but in no event later than one year from the date of this Amendment. Paragraph (4) of the Agreement is amended to read as follows: (4) The 1.15 Acre Permanent Easement shall be used solely to construct, maintain, and operate (a) one water pipeline not to exceed 12 inches inside diameter (including connecting pipelines to serve all parts of the Reasoner Tract) for the transmission and distribution of water; and Co) one 24 inch inside diameter wastewater pipeline (including connecting pipelines to serve all parts of the Reasoner Tract). However, if the City is not allowed to serve the Reasoner Tract with water at the time requested by the Reasoners, or their successors or assigns, nevertheless, the City shall grant to the person who is permitted to provide such water service an easement of sufficient width within the 1.15 Acre Permanent Easement, at not cost, for the construction, maintenance, and operation of a water pipeline to provide water service to the Reasoner Tract. Paragraph (8) of the Agreement is amended to read as follows: (8) The construction of the 24 inch inside diameter wastewater pipeline within the 1.15 Acre Permanent Easement shall be completed within one year after the effective date of this Amendment (the "Initial Construction Period"). Paragraph (10) of the Agreement is amended to read as follows: (10) The 1.77 Acre Permanent Easement shall be used solely by the City to construct, maintain, repair, and operate a first-class, paved roadway and necessary drainage for the roadway, and to construct and maintain four curb cuts, a minimum width of 25 feet, to access the Reasoner Tract.
