<br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE NO. 1979-11 <br /> <br />48 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, <br />REAPPROPRIATING FUNDS ORIGINALLY <br />APPROPRIATED BY ORDINANCE 1977-36, <br />ADOPTED ON SEPTEMBER 12, 1977 AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos <br />adopted the budget for the City of San Marcos, Texas, for <br />the fiscal year beginning on October 1, 1977 and ending on <br />September 30, 1978, on September 12, 1977, by Ordinance <br />1977-36; and, <br /> <br />WHEREAS, that budget allocated $22,200 from Revenue <br />Sharing Entitlement 9 for the renovation and repair of the <br />building which was the former City Hall of the City of <br />San Marcos so that the building could be used by the Texas <br />Museum of History and for other cultural activities; and, <br /> <br />WHEREAS, $19,649.43 of that allocation has not been <br />spent; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos has <br />determined that said building is not suitable for and cannot <br />be economically renovated for such a purpose; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos <br />designated a site for the location of a public museum to be <br />constructed under the supervision of the Texas Museum of <br />History, Inc. and to be owned by the City of San Marcos in <br />Ordinance 1977-46, adopted on November 7, 1977; and, <br /> <br />WHEREAS, Section 8.16 of the Charter of the City of <br />San Marcos allows appropriations alterations in cases of public <br />necessity; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos finds <br />such a public necessity in the need for prompt removal of the <br />artifacts presently stored in said building, provision of a <br />permanent facility for their storage, and disposal of said <br />building by the City; and, <br /> <br />WHEREAS, the City Council desires to reallocate $19,649.43 <br />of Revenue Sharing Entitlement 9, originally appropriated by <br />Ordinance 1977-36; the reallocation to be to a construction <br />fund for a public museum on the site designated by Ordinance <br />1977-46 to be constructed under the supervision of the Texas <br />Museum of History, Inc. and to be owned by the City of <br />San Marcos; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1: That $19,649.43 originally appropriated by <br />Ordinance 1977-36, be, and is hereby, appropriated to a fund <br />to be maintained by the City of San Marcos, Texas, and to be <br />established for the construction under the supervision of <br />the Texas Museum of History, Inc. of a public museum on the <br />site designated by Ordinance 1977-46 of the City of San Marcos. <br /> <br />SECTION Z: That appropriations from said fund shall not <br />be made for architectural or related planning expenses and <br />shall be used only for actual construction costs unless other- <br />wise authorized by the City Council of the City of San Marcos. <br /> <br />SECTION 3: That if construction of the public museum is <br />not substantially completed within the time limit prescribed <br />by Ordinance 1979- q , any funds remaining shall be reallocated <br />by the City Counci~ the City of San Marcos. <br />
