<br />82 <br /> <br />regular meeting, april 16, 1979 <br /> <br />page two <br /> <br />The Mayor Pro Tern read an ordinance having the following <br />caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, CONTINUING <br />THE TAXES IMPOSED BY THE LOCAL SALES AND <br />USE TAX ACT (ARTICLE 1066c, VERNON'S <br />TEXAS CIVIL STATUTES) ON THE SALE AND <br />DISTRIBUTION OF GAS AND ELECTRICITY FOR <br />RESIDENTIAL USE WITHIN SAN MARCOS, TEXAS; <br />DECLARING AN EMERGENCY; AND ESTABLISHING <br />AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Breihan moved to adopt the ordinance on emergency basis <br />provided that the sales tax money received not be used to <br />subsidize the City Utility Fund. Mr, Hansen seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Breihan, Hansen, Hyatt, James, <br />Tenorio <br />NAY: Sutton. <br /> <br />The Mayor read the caption of a resolution as follows: <br /> <br />Jd <br /> <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, <br />SUSPENDING THE OPERATION OF PROPOSED RATE <br />SCHEDULES FILED BY LOWER COLORADO RIVER <br />AUTHORITY FOR A PERIOD OF ONE HUNDRED TWENTY <br />(120) DAYS BEYOND APRIL 25, 1979, THE DATE <br />ON WHICH SUCH SCHEDULES WOULD OTHERWISE GO <br />INTO EFFECT. <br /> <br />Mr. Hansen moved the resolution be adopted. Mr. James seconded <br />the motion which passed unanimously. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING A <br />CONTRACT BETWEEN THE CITY OF SAN MARCOS <br />AND UTILITY DEVELOPERS, INC. OF SAN ANTONIO, <br />TEXAS, FOR CONSTRUCTION OF A SOUTHEAST <br />WATER LINE EXTENSION, AND AUTHORIZING THE <br />MAYOR TO EXECUTE SAID CONTRACT ON BEHALF <br />OF THE CITY. <br /> <br />I <br /> <br />The Mayor Pro Tern read the caption of a resolution as follows: <br /> <br />Mr. Hansen moved the resolution be adopted and the contract <br />with Utility Developers, Inc. in~~e amount of $88,852.00 <br />be approved. Mr. James seconded t~e motion which passed <br />unanimously. <br /> <br />Mr. Hyatt introduced for consideration authorization for <br />staff to advertise for bids to be received on sanitation <br />equipment. The City Manager explained that Revenue Sharing <br />Entitlement #10 contained monies for the purchase of 100 <br />side loading sanitation containers and one side loading <br />truck to be used by the Sanitation Department. Mr. Breihan <br />requested that the containers be bid so as to get alternate <br />prices on metal lids and plastic lids. Mr. Hansen moved <br />the staff be authorized to advertise for bids to be received I <br />on 100 sanitation containers. Mr. Sutton seconded the motion <br />I.hich passed unanimously. Mr. Hansen moved to authorize <br />advertisement for bid of the side loading sanitation truck. <br />Mr. James seconded the motion which passed unanimously, <br /> <br />The Mayor Pro Tern read the caption of a resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, DESIGNATING <br />POLLING PLACES FOR THE SPECIAL RUN-OFF <br />ELECTION TO BE HELD IN SAID CITY ON THE <br />5TH DAY OF MAY , 1979; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Hansen moved the resolution be adopted.
