<br />I <br /> <br />I <br /> <br />I <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />I <br />I <br /> <br />FIRE PROTECTION AGREEMENT <br /> <br />KNOW OF ALL MEN BY THESE PRESENTS: <br /> <br />That on this 25th day of September, 1978, the City of <br />San Marcos, Hays County, Texas, a municipal corporation exist- <br />ing by and under the laws of the State of Texas, hereinafter <br />referred to as "City", and the County Commissioners of Hays <br />County, Texas, hereinafter referred to as "County", entered <br />into this Fire Protection Agreement; the terms, conditions and <br />consideration of said agreement being as follows: <br />I. <br />City and County mutually agree that persons and property <br />located in Hays County, but outside the corporate limits of the <br />City of San Marcos, need fire protection services. <br />II. <br />It is understood by both parties that the City has exist- <br />ing organized fire protection personnel and equipment which <br />could be made available on a shared-cost basis. <br />III. <br />In order to bring this protection to persons and property <br />located outside of the corporate limits, the City hereby agrees <br />to furnish for the use and benefit of citizens of Hays County, <br />fire fighting equipment, together with such personnel as are <br />necessary to maintain and operate the same on an "on-call" basis <br />from existing fire stations in the City, during the life of this <br />contract, which shall be for one calendar year from October I, <br />1978 to September 30, 1979 (or if executed after October 1, 1978, <br />then from date of execution to September 30, 1979). The fire <br />protection services herein described will not be provided after <br />October 1, 1978 without approval and execution of this contract, <br />and will be subject to the following terms and conditions: <br />A. The City through its employees, when not required for <br />fire protection service within the City, may respond to <br />calls for assistance from persons reporting fires located <br />in Hays County, but outside the corporate limits of the <br />City of San Marcos, during the life of this contract. <br />
