<br />66 <br /> <br />regular meeting, september 18, 1978 <br /> <br />page two <br /> <br />Representatives of the applicant were not present. <br />Mr. Hyatt explained that the public hearing had been <br />held on September 11 and that the applicant's agent <br />had explained that no on-premises consumption of <br />alcoholic beverages was desired but that the business's <br />ability to sell alcoholic beverages for off-premises <br />consumption needed to be protected against persons open- <br />ing purchased beverages before leaving the property. <br />The City Attorney advised that the applicant could limit <br />his state license to the building only and thus protect <br />himself without changing the zoning and obtaining an on- I <br />premises consumption permit. Mr. Sutton moved the <br />ordinance not be approved. Mr. James seconded the motion, <br />which passed unanimously. Mr. Arredondo arrived just after <br />this roll call vote. <br /> <br />Mr. Hyatt read the caption of a resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AWARDING A <br />BID AND APPROVING A CONTRACT BETWEEN THE <br />CITY OF SAN MARCOS AND DIVISION II <br />CONSTRUCTORS, INC. FOR THE CONSTRUCTION <br />OF SIDEWALKS IN THE AREA OF TRAVIS <br />ELEMENTARY SCHOOL IN THE CITY OF SAN MARCOS, <br />TEXAS; AND AUTHORIZING THE MAYOR TO EXECUTE <br />SAID CONTRACT ON BEHALF OF THE CITY. <br /> <br />Mr. Sutton moved the resolution be adopted awarding a <br />contract in the amount of $8,876.05. ,Mr. l'lansen seconded <br />the motion which passed unanimously. <br /> <br />Mr. Hyatt read the caption of a resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, EXPRESSING <br />SUPPORT FOR THE CONSTITUTIONAL AMENDMENT <br />TO BE CONSIDERED AT THE NEXT GENERAL <br />ELECTION ALLOWING POLITICAL SUBDIVISIONS <br />TO ISSUE REVENUE BONDS TO CREATE JOBS <br />FOR CITIZENS. <br /> <br />I <br /> <br />Mr. Arredondo moved the resolution be adopted. Mr. James <br />seconded the motion which passed unanimou~ly. <br /> <br />Mr. Arredondo moved to authorize the Acting City Manager <br />to initiate arrangements for a gas rates study to be <br />conducted on behalf of the City. Mr. Hansen seconded <br />the motion, which passed unanimously. <br /> <br />At 8:30 p.m., Council recessed into executive session to <br />discuss pending litigation on motion of Mr. Hansen and <br />second of Mr. Breihan. Council reconvened at 8:55 p.m. <br />on motion of Mr. Hansen and second of Mr. Breihan. <br />Mr. Hansen moved to authorize legal counsel to proceed <br />with whatever litigation was nece~sary in the Lower <br />Colorado River Authority case.
