89 regular meeting, october 23, 1978 page two Mayor Cavazos opened a public hearing and read an ordinance in its entirety having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGU- LATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (YOL. 32) BY CHANGING THE. ZONING OF PART OF LOT 7, BLOCK 3, J. D. I ROGERS ADDITION (SEE METES AND BOUNDS DESCRIPTION ATTACHED AS EXHIBIT A) , LOCATED AT 603 BLANCO, FROM "R-l" (RESIDENTIAL) TO "R- 2" (DUPLEX). Mr. James Ragsdale, applicant, was present to answer questions the Council might have. Mayor Cavazos informed the public that the Planning and Zoning Commission had recommended denial and that objections had been received. Mr. Ragsdale stated he would like to build a duplex. Since the Planning and Zoning Gommission recommended denial, Council was required to approve the ordinance by a 3/4's majority. Mr. Krauskopf reported that Mr. Ragsdale would still have to replat the property in order to build the duplex, unless 'the single-family residence on the other portion of the lot were removed. Mr. Breihan suggested to Mr. Ragsdale to withdraw his application for zoning, have the property replatted, reapply for zoning which would go back to the Planning and Zoning Commission and then bring it back to the Council. He stated Mr. Ragsdale would have more of a chance in the ordinance being accepted. Mr. Breihan also stated if the request was denied, he would have to wait 12 months before being able to reapply again. Mayor Cavazos closed the public hearing. Mr. Hyatt moved the ordinance be approved on first reading providing the metes and bounds, as itemized, were followed. Mr. Breihan seconded the motion. I On roll call, the following vote was recorded: AYE: Sutton, Breihan, Hansen, Cavazos, Hyatt NAY: James, Arredondo. Since six Aye votes were required to grant the request and only five received, the requested zoning change was denied. Mayor Cavazos opened a public hearing and read an ordinance in its entirety having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGU- LATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (YOL. 32) BY CHANGING THE ZONING OF PARTS OF LOTS 22, 23, 24 AND 25 OF THE CHARLES MEINERS ADDITION, LOCATED AT 1503 LOOP 82, FROM "C" (COMMERCIAL) TO "C-2" (COMMERCIAL). Mr. and Mrs. Arthur Schroder are the applicants. The Planning I and Zoning Commission recommended approval. Objections were received but did not represent 20% of the surrounding property. Mrs. Barbara Schroder was present stating she was the owner and manager of I. M. Hungry Delicatessen and she would like to sell beer for customers who asked for beer and food. Mr. Rod Gilmore objected to the zoning for the safety of his children. Mayor Cavazos closed the public hearing. Mr. James moved the ordinance be approved on first reading. Mr. Hyatt seconded the motion. On roll call, the following vote was recorded: AYE: Sutton, Breihan, Hansen, Cavazos, Hyatt, James NAY: Arredondo.
