<br />89 <br /> <br />regular meeting, october 23, 1978 <br /> <br />page two <br /> <br />Mayor Cavazos opened a public hearing and read an ordinance <br />in its entirety having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />SECTION 3 OF THAT ORDINANCE WHICH REGU- <br />LATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED <br />MAY 23, 1966 (YOL. 32) BY CHANGING THE. <br />ZONING OF PART OF LOT 7, BLOCK 3, J. D. I <br />ROGERS ADDITION (SEE METES AND BOUNDS <br />DESCRIPTION ATTACHED AS EXHIBIT A) , <br />LOCATED AT 603 BLANCO, FROM "R-l" <br />(RESIDENTIAL) TO "R- 2" (DUPLEX). <br /> <br />Mr. James Ragsdale, applicant, was present to answer questions <br />the Council might have. Mayor Cavazos informed the public <br />that the Planning and Zoning Commission had recommended denial <br />and that objections had been received. Mr. Ragsdale stated he <br />would like to build a duplex. Since the Planning and Zoning <br />Gommission recommended denial, Council was required to approve <br />the ordinance by a 3/4's majority. Mr. Krauskopf reported that <br />Mr. Ragsdale would still have to replat the property in order <br />to build the duplex, unless 'the single-family residence on the <br />other portion of the lot were removed. Mr. Breihan suggested <br />to Mr. Ragsdale to withdraw his application for zoning, have <br />the property replatted, reapply for zoning which would go back <br />to the Planning and Zoning Commission and then bring it back <br />to the Council. He stated Mr. Ragsdale would have more of a <br />chance in the ordinance being accepted. Mr. Breihan also <br />stated if the request was denied, he would have to wait 12 <br />months before being able to reapply again. Mayor Cavazos <br />closed the public hearing. Mr. Hyatt moved the ordinance be <br />approved on first reading providing the metes and bounds, as <br />itemized, were followed. Mr. Breihan seconded the motion. The Planning I <br />and Zoning Commission recommended approval. Objections were <br />received but did not represent 20% of the surrounding property. <br />Mrs. Barbara Schroder was present stating she was the owner <br />and manager of I. M. Hungry Delicatessen and she would like to <br />sell beer for customers who asked for beer and food. <br />Mr. Rod Gilmore objected to the zoning for the safety of his <br />children. Mayor Cavazos closed the public hearing. Mr. James <br />moved the ordinance be approved on first reading. Mr. Hyatt <br />seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Sutton, Breihan, Hansen, Cavazos, <br />Hyatt, James <br />NAY: Arredondo. <br />
