97 City of San Marcos San Marcos, Texas I Re: Earnest Money Contract, dated March 10, 1978, between the City of San Marcos and W. R. Skipping, Trustee, with respect to 0.9502 acres described in deed recorded in Volume 46, Page 448, Hays County Deed Records Dear Mr. Mayor: This letter concerns the above described contract, and the situation in which Balconies Savings Association now finds itself. As you may recall when the Council approved the contract described on March 6 1978. The association anticipated its hearing before the Commissioner on March 28, 1978 with the Commissioner's ruling to approve or disapprove our application to follow 60 days later. His ruling was unprecedented and required that the hearing be reopened on September 8, 1978 which was later postponed by the Commissioner un- til September 22, 1978. I The hearing was reopened and closed on September 22, 1978. Our Council advises us that the Commissioner is required to rule on our appl ication and advise all parties prior to December 1. This means that we will not be notified until after the termination date of our contract. For this reason we respectifully request an extension of the contract until December 1, 1978 or upon notification by the Commissioner which- ever shall fi rst occur. an extremely conclusive. contract can The organizers and directors firmly believe that we have good case and that the evidence presented at the hearing is We bel ieve that the charter will be granted and that the be closed.
