<br />140 <br /> <br />regular meeting, december 18, 1978 <br /> <br />page two <br /> <br />read an ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br />FIXING AND ORDERING THE RATES TO BE CHARGED BY <br />ENTEX, INC., FOR GAS AND GAS SERVICE TO <br />RESIDENTIAL AND COMMERCIAL CUSTOMERS WITHIN <br />THE CITY OF SAN MARCOS, TEXAS; PROVIDING FOR <br />THE FILING OF AN ANNUAL OPERATING REPORT; <br />PLACING CERTAIN FILING LIMITATIONS; ESTABLISHING <br />THE EFFECTIVE DATE THEREOF; REPEALING ALL <br />ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING <br />FOR SEVERABILITY. <br /> <br />I <br /> <br />Mr. Sutton moved the ordinance be approved on first reading. <br />Mr. Breihan seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: Cav:nos, Hyatt, James, Sutton, <br />Breihan, Hansen <br />NAY: Arredondo. <br /> <br />Mr. Sutton requested the City Manager meet with consultants <br />and report to the Council regarding their findings on the <br />new rate schedules submitted by Entex. <br /> <br />The Mayor presented for consideration recommendations made for <br />revision of the San Marcos Charter. Council first discussed <br />the recommendation for direct election of the Mayor to serve <br />a two-year term. Mr. R. G. Phillips encouraged the Council to <br />give the Mayor more administrative control and stated his <br />support for direct election of the Mayor. Mr. Hyatt said he <br />would be opposed to direct election of the Mayor as outlined <br />in the recommendation unless Council Members terms were <br />reduced to two years. Mr. Hyatt said his opposition was based <br />on the State Constitutional provision which would require a <br />Council Member serving a three-year term to resign from office I <br />if announcing to run for another office than the one currently <br />held. Mr. Hyatt said he didn't think it would be fair for <br />Council Members to have to resign in order to run for Mayor <br />and that in some instances such an action might require a <br />special Election to be held. Action on the recommended <br />proposition was deferred until later in the meeting. <br /> <br />Council next discussed the recommendation for compensation to <br />the Mayor and Council Members in the form of $500 per month <br />for the Mayor and $300 monthly for each Council Member. <br />Mrs. Dawn Smith stated her opposition to any compensation <br />other than reimbursement of necessary expenses. Mr. Barton <br />pointed out that the League of Women Voters had endorsed <br />compensa tion as recommended. MT. R. G. Phillips concurred <br />saying he felt persons would be more responible if paid. <br />Mr. James agreed that compensation was in order but suggested <br />the Council lower the compensation to $300 per month for the <br />Mayor and $100 for Council Members monthly. Mr. Sutton <br />cautioned the Council against jeopardizing federal funding by <br />giving increases in salary greater than the 7% recommended by <br />President Carter. Mr. Breihan suggested $30 per meeting for <br />Council Members and $60 per meeting for the Mayor would be <br />most appropriate. Mr. Cavazos moved the proposed proposition <br />providing for monthly salary of $500 for the Mayor and $200 I <br />for each Council Member be approved for placement on the <br />April Election ballot. Mr. Hansen seconded the motion. On <br />roll call, the following vote was recorded: <br /> <br />AYE: Hyatt, Arredondo, Hansen, Cavazos <br />NAY: James, Sutton, Breihan. <br /> <br />The Mayor next introduced the third recommendation of the <br />Charter Review Commission: Amendment of Section 3.05 to <br />give the Mayor the duty to act as principal liaison between <br />Council Members and the City Manager and removing the phrase <br />which provides that the Mayor shall have no regular <br />administrative duties. Mr. Gilbert Tenorio told the Council <br />that he felt this was intended to weaken the City Manager <br />
