<br />178regu1ar meeting, january 29, 1979 <br /> <br />page two <br /> <br />The Mayor read the caption of an Ordinance as fo11ow.s; <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY <br />THE CITY OF SAN MARCOS, TEXAS, OF LOT 6 AND A PORTION OF <br />LOTS 2, 3, 7 AND 8 AND AN ABANDONED ALLEY, ALL IN BLOCK 21 <br />OF THE ORIGINAL TOWN OF SAN MARCOS (FURTHER DESCRIBED BY <br />METES AND BOUNDS IN ATTACHED EXHIBIT A), ALSO KNOWN AS <br />URBAN RENEWAL PARCEL NUMBER 1-1, LOCATED WITHIN THE TEX. <br />A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM AREA TO LEWIS GILCREASE, <br />TRUSTEE FOR BALCONES SAVINGS ASSOCIATION; AUTHORIZING THE <br />MAYOR TO EXECUTE A WARRANTY DEED TO LEWIS GILCREASE, TRUSTEE I <br />FOR BALCONES SAVINGS ASSOCIATION; AND DECLARING AN EFFECTIVE <br />DATE. .. <br /> <br />Mr. Hansen moved the Ordinance be adopted on third and final reading. <br />Mr. Hyatt seconded the motion, which passed unanimously. <br /> <br />The ~1ayor introduced for consideration payment of special legal <br />counsel fees incurred in the Backus suit filed in Federal Court. <br />Mr. Sutton moved to approve payment of $2,551.36 to the firm of <br />McGinnis, Lochridge and Kilgore. Mr. James seconded the motion, <br />which passed unanimously. Mr. Breihan requested the staff obtain <br />a breakdown of the charges involved in the base fee charged by the <br />attorneys. <br /> <br />Mrs. Dawn Smith came before the Council to request reconsideration of <br />the request that charter amendment propositions regarding initiative <br />and referendum priviledges for ordinances pertaining to bonds, taxes <br />and budgets be placed on the April election ballot. Council Members <br />Hyatt, Arredondo, Breihan, Sutton and Hansen said they felt the petition <br />procedure available to persons wishing charter amendment propositions <br />be placed on election ballots should be used since the Council had <br />already considered the question. Mr. Sutton moved the item not be <br />reconsidered. Before a second could be made Mr. Arredondo moved to <br />table further consideration of the question.
