<br />17 <br /> <br />regular meeting, april 26, 1976 <br /> <br />page two <br /> <br />The Mayor opened a public hearing to discuss a proposed amendment to the <br />ordinance regulating the private hauling of garbage. Mr. Breihan stated his <br />objection to the provision in Section l2-l2(d) of the proposed ordinance which <br />limits the vehicles to "closed body refuse hauling" types. No other objection <br />was made. The Mayor closed the hearing and read the ordinance having the <br />follm<'1ng caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />c.ECTION 12-12 OF THE CODE OF ORDINANCES OF THE CITY, ENTITLED "PRIVATE <br />GARBAGE COLLECTION, REMOVAL AND DISPOSAL GENERALLY", BY REQUIRING COMPLIANCE <br />WITH ARTICLE 670lh, R.C.S. OF TEXAS IN PROVIDING FINANCIAL RESPONSIBILITY I <br />FOR DAMAGE, BY REDUCING THE PERMIT FEE FROM $250 TO $25; AND BY REMOVING <br />THE WORD "TRASH" SO AS TO CAUSE SAID ORDINANCE TO REGULATE ONLY THE PRIVATE <br />HAULING OF GARBAGE AS DEFINED IN CHAPTER 12 OF SAID CODE. <br /> <br />Mr. Breihan moved to amend the ordinance by changing the following wording in <br />paragraph d:"closed body refuse hauling type with watertight seals"; to read as <br />follows: "shall be elJ.uipped with a watertight closed body or with approved water- <br />tight containers....". Mr. Hansen seconded the motion, which passed unanimously. <br />Mr. Hansen moved the Ordinance, as amended, be approved on first reading. <br />Mr. Breihan seconded the motion, which passed unanimously. <br /> <br />The Mayor read an Ordinance, the caption for which is as follows: <br /> <br />~'l ORDINANCE APPROVING THE PRICE AND CONJ)ITIONS OF THE SALE BY THE URBAN <br />RENEWAL AGENCY OF THE CITY OF SAN MARCOS, TEXAS, OF PARCEL NO. 5-1 (SEE <br />LEGAL READING, LOCATED WITHIN THE JUAN VERAMENDI PROJECT, N.D.P., TEX. A-6, <br />TO URA LEE BEARD AND LEE J. BEARD, AND DECLARING AN EMERGENCY. <br /> <br />Mr. Sutton moved the Ordinance be adopted. Mr. Hansen seconded the motion, which <br />passed unanimously. <br /> <br />The Mayor introduced and read an Ordinance, the caption of which is as follows: <br /> <br />All ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE URBAN RENEWAL <br />AGENCY OF THE CITY OF SAN MARCOS, TEXAS, OF PARCEL NO. 15D-12 (SEE <br />LEGAL READING, LOCATED WITHIN THE JUAN VERAMENDI PROJECT, PROJECT <br />N.D.P., TEX. A-6, TO GERONIMO RODRIGUEZ AND ROMANA RODRIGUEZ, AND <br />DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />Mr. Arredondo moved the Ordinance be adopted. Mr. Hansen seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Craddock read the caption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN H. GARLAND STOKES, MILDRED O. STOKES, <br />AND HERBERT A. YARBROUGH, JR., AND THE CITY OF SAN MARCOS FOR THE <br />EXCHANGE OF RIGHT-OF-WAY LOCATED AT THAT PROPERTY COMMONLY KNOWN AS <br />"THE OLD MILL PROPERTY" AND AUTHORIZING THE MAYOR TO EXECUTE SAID <br />AGREEMENT IN AND ON BEHALF OF THE CITY OF SAN MARCOS, TEXAS. <br /> <br />Mr. Hansen moved adoption of the Resolution. Mr. Sutton seconded the motion. <br />Mr. Breihan recommended the agreement be amended to provide on page three for <br />a three year lease of the private right-of-way instead of the proposed two year <br />lease. Mr. Sutton suggested the agreement provide that Stokes-Yarbrough agree <br />to fund the construction of the new street in the event they broke the lease. <br />Mr. Sutton moved the amend the agreement to delete the reference to the "Compre- <br />hensive Plan" so that the sentence on the first page containing that reference <br />be amended to read as follows: "WHEREAS, the City_desires to obtain title to a I <br />fifty foot (50') strip of land, to run along the Southern and Western sides of <br />the abovedescribed real property, for the purpose of constructing a street <br />thereon, such aClJ.uisition and construction to be in accordance with City of San <br />Marcos street design criteria". Mr. Cavazos seconded the motion to amend, which <br />passed unanimously. The motion to adopt the Resolution passed unanimously. <br />
