Contract ID #: DIR- SDD -IC510 <br />INTERLOCAL COOPERATION CONTRACT <br />THIS INTERLOCAL COOPERATION CONTRACT is entered into by and between City of San Marcos <br />a political subdivision of the State of Texas (Customer), and the STATE OF TEXAS, acting by and <br />through the DEPARTMENT OF INFORMATION RESOURCES, 300 West 15 Street, Suite 1300, <br />Austin, Texas 78701 [DIR], pursuant to the authority granted and in compliance with the provisions of the <br />Interlocal Cooperation Act, Texas Government Code, Chapter 791. <br />I. STATEMENT OF PURPOSE: <br />The purpose of this Interlocal Cooperation Contract [Contract] is for DIR to conduct certain <br />security testing for Customer, in accordance with the attached Statement of Work. <br />II. PAYMENT FOR GOODS AND SERVICES: <br />a. Customer shall reimburse DIR for $5,000 in conducting the security testing for Customer. <br />DIR will issue an invoice to Customer within thirty (30) days of the completion of the test. <br />Payment must be made from current revenues available to Customer and authorized by its <br />governing board. The billing address for Customer is: <br />City of San Marcos <br />630 E. Hopkins St. <br />San Marcos, Texas 78666 <br />b. Customer agrees to pay the rates and /or prices set by DIR. Customer understands these rates <br />and /or prices include a DIR administrative fee. <br />III. TERM OF CONTRACT: <br />This Interlocal Cooperation Contract shall begin when fully executed by both parties and shall <br />continue until terminated <br />[choose a specific number of months or state, "until terminated." <br />Either party, upon written notice, may cancel this contract and shall be obligated to complete all <br />purchases ordered at the date of termination. <br />The parties to this Contract hereby certify, by signing in the spaces provided below that this <br />Contract is authorized by the governing body of each party and that this Contract neither requires <br />nor permits either entity to exceed its respective duties and responsibilities or the limitations of its <br />appropriated funds. This Contract shall not become valid until signed by duly authorized <br />representatives of both parties and may not be amended except in writing and duly signed by both <br />parties. <br />Department of Information Resources Page 1 of 2 (DIR REV. 03/12/09) <br />
