RESOLUTION 2010 -43R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE PROCUREMENT OF REPAIR <br />SERVICES FOR AN AERIAL FIRE TRUCK FROM SCOTT <br />APPARATUS, INC., THE LOCAL REPRESENTATIVE OF SMEAL FIRE <br />APPARATUS COMPANY AS A PROCUREMENT EXEMPT FROM THE <br />STATE COMPETITIVE BIDDING PROCEDURE IN THE ESTIMATED <br />AMOUNT OF $79,654.04; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE APPROPRIATE PROCUREMENT DOCUMENTS ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />1. On February 2, 2010, a city owned aerial fire truck, No. 3, Unit #52 -300 was <br />involved in a crash while on the scene of a separate crash. <br />2. Section 252.022 (3) of the Texas Local Government Code permits a limited <br />exemption from the State competitive bidding procedure for a procurement necessary due to <br />unforeseen damage to public machinery, equipment or other property. <br />3. The City considers this equipment a procurement exempt under the Texas Local <br />• Government Code's competitive bidding procedures because this aerial truck was custom <br />manufactured by Smeal Fire Apparatus Company and the City must return the truck for repair to <br />the manufacturer through its local representative, Scott Appartus, Inc. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The exempt procurement of repair services for aerial fire truck No. 3, Unit <br />#52 -300 for the Fire Department in the estimated amount of $79,654.04 is approved. <br />PART 2. The City Manager, Rick Menchaca is authorized to execute purchasing <br />documents on behalf of the City. <br />PART 3. This Resolution will be in full force and effect immediately from and after <br />its passage. <br />ADOPTED this the 23rd day of March, 2010. <br />• <br />
