Attachment 2 <br />Terms and Conditions of the Prime Award and Other Special Terms and Conditions <br />This Agreement is made as a result of the Bureau of Justice Assistance's Cooperative Agreement No. <br />2009- D1- BX -K034, "Advanced Law Enforcement Rapid Response Training ", that was awarded to <br />University. This project is supported under FY09 (BJA- Congressionally Recommended) Pub. L. No. <br />111 -8, 123 Stat. 524, 580. Subrecipient agrees to abide by these provisions, including the appropriate <br />administrative and cost guidelines. Where approval is required from Bureau of Justice Assistance, <br />such approval shall be sought from University. <br />Terms and Conditions <br />1. The Subrecipient agrees to comply with the financial and administrative requirements set forth <br />in the effective edition of the "OJP Financial Guide ". <br />2. The Subrecipient acknowledges that failure to submit an acceptable Equal Employment <br />Opportunity Plan (if the Subrecipient is required to submit one pursuant to 28 CFR 42.302), <br />that is approved by the Office of Civil Rights, is a violation of its Certified Assurances and <br />may result in the suspension of the drawdown of funds. <br />3. The Subrecipient agrees to comply with the organizational audit requirements of OMB Circular <br />A -133, Audit of States, Local Governments, and Non - Profit Organizations, and further <br />understands and agrees that funds may be withheld, or other related requirements may be <br />imposed, if outstanding audit issues (if any) from OMB Circular A -133 audits (and any other <br />audits of OJP grant funds) are not satisfactorily and promptly addressed, as further described in <br />the current edition of the OJP Financial Guide, Chapter 19. <br />4. The Subrecipient understands and agrees that it cannot use any federal funds, either directly or <br />indirectly, in support of the enactment, repeal, modification or adoption of any law, regulation <br />or policy, at any level of government, without the express prior written approval of OJP. <br />5. The Subrecipient understands and agrees that no portion of these federal grant funds shall be <br />used towards any part of the annual cash compensation of any employee of the grantee whose <br />total annual cash compensation exceeds 110% of the maximum salary payable to a member of <br />the Federal government's Senior Executive Service at an agency with a Certified SES <br />Performance Appraisal System for that year. This prohibition may be waived on an individual <br />basis at the discretion of the Assistant Attorney General for OJP. <br />Compliance Assurances and Certifications. Subrecipient certifies, by signing this document that the <br />following assurances and certifications that apply to the University's prime grant are met. Such <br />assurances and certifications required by the Subrecipient shall include but are not necessarily limited <br />to: <br />Civil Rights. Compliance with Title VI of the Civil Rights Act of 1964. <br />Handicapped Individuals. Compliance with Section 504 of the Rehabilitation Act of 1973 as <br />amended. <br />
