Mr. James seconded the motion. <br />Mr. Breihan requested the Council consider retaining the drainage easement <br />across the back of the lot. On roll call, the following vote was recorded: <br /> <br />Aye: Arredondo, Hansen, James, Sutton, Cavazos, Craddock <br />Nay: Breihan <br /> <br />T:Je Mayor read an ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS , APPROVING THE PRICE AND CONDITIONS OF THE SALE BY <br />THE CITY OF SAN MARCOS, TEXAS, OF ALL OF LOT 5 AND A PORTION <br />OF WI' 4, BLOCK 2, IN THE KATY ADDITION FURTHER DESCRIBED <br />BY METES AND BOUNDS IN ATTACHED "EXHIBIT A", LOCATED WITHIN <br />THE TEX. A-5, NEIGHBORHOOD DEVELOPMENT PROGRAM AREA TO <br />JAMES M. HARRISON AND LEWIS E. HARRISON, JR.; AUI'HORIZING <br />THE MAYOR TO EXECUTI A WARRANTY DEED TO JAMES M. HARRISON <br />AND LEWIS E. HARRISON, JR.; AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />I <br /> <br />Dr. Craddock moved the ordinance be approved. Mr. Cavazos seconded the <br />rrotion. Council discussed the proposed development with James and Lewis <br />Harrison. Dr. Craddock m::>ved the emergency clause in the ordinance be <br />removed and that it be considered on three readings. Mr. James seconded <br />the m::>tion which passed unanimously. On the rrotion to approve the <br />ordinance as amended, Council Members voted unanimously in favor. <br /> <br />The Mayor read an ordinance having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ACCEPTING THE BID OF PEDRO AND FRANCISCA RODRIGUEZ <br />FOR THE PURCHASE OF PART OF WI'S 2, 3, 4, 5 AND ALL OF LOTS <br />7 AND 8, BLOCK 11, D. S. COMBS ADDITION; AUI'HORIZING THE <br />MAYOR TO EXECUTI A SPECIAL WARRANTY DEED TO SAID BIDDERS ON <br />BEHALF OF THE CITY OF SAN MARCOS, IN TRUST FOR ITSELF THE <br />STATE OF TEXAS, COUNTY OF HAYS AND THE SAN MARCOS CONSOLIDATED <br />INDEPENDENT SCHOOL DISTRICT; AND DEClARING AN EMERGENCY. <br /> <br />I <br /> <br />Mr. Breihan moved the ordinance be tabled until the engineers could report <br />on the overall plan for drainage in the area. There was no second to <br />Mr. Breihan I s motion. Mr. Sutton moved the ordinance be adopted. Mr. Cavazos <br />seconded the motion. Mr. Breihan stated his concern that the City was selling <br />property in a flood plain when it had concentrated efforts on clearing the <br />area. Mr. Sutton stated his feeling that it seemed only fair to give the <br />Rodriguez the opportunity to redeem their property which has been taken for <br />delinquent taxes. Dr. Craddock suggested a compromise in the way of selling <br />back only a portion of the property requested and retaining half of the <br />lDt 6, 7 and 8 along Purgatory Creek. Dr. Craddock moved to table the <br />ordinance pending a report from the City Engineers on how much property <br />would be needed for an easement to rraintain Purgatory Creek. Mr. Breihan <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />Aye: Sutton, Breihan, Craddock, Arredondo, Hansen, James <br />Nay: Cavazos <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICI'S THE LOCATION AND USE OF BUILDINGS, STRUCI'URES <br />AND lAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE <br />ZONING OF PART OF FARM LOT 5, FURTHER DESCRIBED BY MErES <br />AND BOUNDS IN ATTACHED EXHIBIT A, LOCATED AT 219 COMAL STREET, <br />FROM "C" (CCl1MERCIAL) TO "P-l" (PUBL.IC). <br /> <br />I <br /> <br />Mr. Hansen moved the ordinance be adopted.
