III. University, by this agreement, does not in any manner or extent relinquish its claim to ownership and right to title to said 50 foot strip of land described in Section II, above, said ownership and title being held under deed and purchase. I IV. City, by this agreement, does not in any manner or extent re- linquish its claim to ownership and right to title to said 50 foot strip of land described in Section II above; said ownership and title being held under deed, dedication to park use, and actual maintenance and us,: for public park purposes. V. In order to postpone potential legal action which might jeopardize and delay University construction now in progress, City and University hereby concurrently agree that a small segment of the 50 foot strip of land described in Section II, above, shall be utilized by City for the purpose of constructing, at City's expense, a right angle (approxi- mately) turn to serve as an extension of the University road as described in Section I, above, said extension to connect to a new road to be sit- I uated on City Park property, at City1s expense, adjacent to the existing boundary between University and City Park property; with said turn and said road being more fully described in EXHIBIT "A". VI. Whereas, the San Marcos City Attorney is of the opinion that City's right of ownership and title in the 50 foot strip of land described in Section II is superior to that of the University, I University hereby agrees to submit, within 30 days from the date of execution of this agreement, all facts regarding the contradictory claims of University and City in this matter to the State Attorney General for his opinion.
