Mr. Hyatt warned the Council against <br />ever referring to the property as University property or <br />including in the agreement words to the effect that the <br />City would maintain the University's property. <br />Mrs. Sullivan and Mr. Conoley, representatives of the Parks <br />and Recreation Board, told the Council that they were only <br />recommending a temporary agreement in order to keep the <br />Park open for use by San Marcos citizens. Council discussed <br />the matter at length. Mr. Breihan suggested the agreement <br />state only that the City and the University, until further <br />arrangements could be made, agreed to exchange the entrance <br />to City Park from the North end of the property to the East <br />corner. Mr. Hyatt urged the Council to include a stipulation <br />in the agreement that the University be required to keep the <br />new entrance open at all timks. Mr. Arredondo requested, <br />that the agreement include the statement that the ownership <br />of the property was in question. The City Manager was <br />directed by common consent of the Council to begin work on <br />drafting an agreement as discussed. <br />The Mayor opened a public hearing to consider a request for <br />a change in the zoning of Lot 6, Block 2 of the W. S. Smith <br />Addition from "R-1" to "R-2". Mr. H.C. Bailes was present <br />to request the zoning change. No objections were presented. <br />The Mayor closed the-hearing and read an ordinance:having <br />the following caption: <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOT 6, BLOCK 2 ' <br />OF THE W. S. SMITH ADDITION, LOCATED <br />AT 737 SMITH AVENUE, FROM "R-1" <br />(SINGLE FAMILY RESIDENTIAL) TO "R-2" <br />(DUPLEX). <br />Mr. Sutton moved the ordinance be approved on first reading. <br />Mr. James seconded the motion which passed unanimously. <br />The Mayor opened a public hearing to consider an ordinance <br />adopting an amended rate schedule for electric service <br />charged retail customers of the Lower Colorado River Authority. <br />City Rate Consultant, James McCord, was present. The only <br />comment from the public was from Mr. Charles Cole who pronosed <br />the Council establish a uniform deposit'for all citizens of <br />the Lower Colorado River Authority, his contention being the <br />current policy was unfair. Following the hearing, the Mayor <br />directed the reading of an ordinance having the following <br />caption: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, REGULATING <br />AND SETTING RATES FOR ELECTRICAL UTILIT- <br />IES; ESTABLISHING PROCEDURES AND REQUIRE- <br />MENTS FOR RATE ADJUSTMENTS; PROVIDING FOR <br />HEARINGS ON RATES AND SERVICES; REQUIRING <br />REPORTS AND STATEMENTS; AND PROVIDING FOR <br />A SAVINGS CLAUSE. <br />Mr. Hansen moved the ordinance be approved on first reading. <br />Mr. James seconded the motion which passed unanimously. <br />Mr. James McCord, City Rate Consultant, came before the <br />Council with information on a study being conducted by <br />Electric Power Engineers, Inc. on the City water and sewer <br />system. The City Manager reported that the Staff had already <br />received valuable information from the rate evaluation even <br />though a rate increase or adjustment would not be proposed <br />until fall.
