<br />146 <br /> <br />regular meeting, may 8, 1978 <br /> <br />page two <br /> <br />Following the public hearing, the Mayor read the ordinance <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOT 5, BLOCK 4 <br />OF THE ORIGINAL TOWN OF SAN MARCOS, <br />220 NORTH EDWARD GARY STREET, FROM "c" <br />(COMMERCIAL) TO "C-2" (COMMERCIAL). <br /> <br />I <br /> <br />Mr. Sutton moved the ordinance be approved on first reading. <br />Mr. Cavazos seconded the motion. On roll call, the follow- <br />ing vote was recorded: <br /> <br />NAY: <br /> <br />Cavazos, Hyatt, James, Sutton, <br />Arredondo, Hansen <br />None <br /> <br />AYE: <br /> <br />The Mayor opened a public hearing to consider a request <br />for a change in the zoning of Lots 110, 114, 115 and <br />116 of the Park Addition, Third Division, from "c" to <br />"C-2". Mr. John Tucker, applicant, was present to request <br />the change. Property owners within 200 feet of the subject <br />property, Mr. and Mrs. Curtis Jenkins and Mr. Mike Martin, <br />were present to object to the change in zoning. Mr. Jenkins <br />stated problems he had had in the past with similar <br />businesses operating near his home which created problems <br />in terms of parking and noise. Two petitions of objection <br />were presen~ed. Those are contained in the permanent zoning <br />file. Following the public hearing, the Mayor read an <br />ordinance havLng the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOTS 110, 114, <br />115 and 116 OF THE PARK ADDITION, <br />THIRD DIVISION, LOCATED AT 817 CHESTNUT <br />STREET, FROM "c" (COMMERCIAL) TO "C-2" <br />(COMMERCIAL). <br /> <br />I <br /> <br />Mr. Arredondo moved the ordinance be tabled, stating he <br />felt it was improper to consider a zoning change so <br />close to a similar request currently in litigation. <br />Mr. Sutton seconded the motion which passed unanimously. <br />The City Attorney recommended that the Council take the <br />item from the table in the near future, stating that he <br />would prepare a memorandum on the case in litigation to <br />help them consider the Tucker request. <br /> <br />The Mayor opened a public hearing to consider a request <br />for a change in the zoning of 12.64 acres in J. M. <br />Verarnendi Survey. Number Two, from "R-l" to "nil. <br />Mr. David Morrison was present to represent the applicant, <br />Billy Miller. Mr. Morrison told the Council that his <br />client intended to construct duplexes, fourplexes and <br />townhouses on the property. No objections were presented <br />to the requested zoning change. The Mayor closed the <br />public hearing and read an ordinance having the following <br />caption: <br /> <br />I <br />
