3S regular meeting, may 16, 1977 page two The Mayor read the caption of a Resolution as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A CONTRACT FOR BUS STOP BENCHES BETWEEN THE CITY OF SAN MARCOS AND MR. JULIUS SADOWSKY, JR., DOING BUSINESS UNDER THE FIRM NAME "BUS STOP ADS", AND AUTHORIZmG THE MAYOR OF THE CITY COUNCIL OF SAN MARCOS TO EXECUTE SAID CONTRACT ON BEHALF OF THE CITY. Dr. Craddock moved the Resolution be adopted. Mr. James seconded the motion. Mr. Sadowsky came before the Council with a presentation on his proposal. He showed the Council proposed designs for the benches 'and said that he would like to request a fifteen year franchise, similar to that approved for the cable tv company. The City AttOrney suggested the Council consider several points before approving the contract: (1) There is presently no existing franchise between the City and the bus company; (2) The continuation of the bus service and the present location of bus stops is not guaranteed; (3) the bus' service is not provided for the benefit of the general public; and (4) There may be other advertising businesses interested in providing such a service should the Council wish to place the franchise out for bids. Mr. Evans further stated that he felt the Council needed an agreement with Southwest Texas State University regarding the shuttle bus system. Mr. Breihan stated his primary concern as that benches be kept neat and not interfere with traffic. Mr. Sadowsky assured the Council he would maintain the area where the benches were placed in a neat and attractive manner. Mr. Arredondo moved the Resolution be tabled until the City Attorney could draw up proper specifications for a contract. Dr. Craddock seconded the motion, which passed unanimously. I The Mayor read an Ordinance having the following. caption: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, CHANGING THE NAME OF LUCIO STREET TO C.M. ALLEN PARKWAY AND DIRECTING THE CITY' MANAGER TO MAKE THE APPROPRIATE CHANGES ON CITY RECORDS. Mr. Sutton moved the Ordinance not be adopted. Mr. Cavazos seconded the motion. The City Manager explained the staff proposed the Ordinance so that the name of the street would be consistent. The Mayor reminded the Council that~Ludio Street had been named for a decorated war veteran. Mr. Sutton saifqe was willing to I leave the name of the street as it was unless the people who lived there wanted it changed. Mr. Cavazos pomnted out other streets inconsistently named. Mr. Arredondo moved the Ordinance be tabled until the Council Gould set a policy for naming streets. Mr. Breihan seconded the motion. Mr. Breihan suggested the Council consider changing the name of the street and naming the park currently known as the Gilcrease property Lucio Park. On roll call, the motion to table the ordinance was defeated by the (). following vote: );;p,. ..... + '::. . " AYE: Arredondo, Hansen, Breihan NAY: James, Sutton, Cavazos, Craddock. The motion to not approve the Ordinance passed with the following vote: AYE: Sutton, Breihan, Cavazos, Arredondo NAY: Hansen, James, Craddock. The Mayor read the caption of an Ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDIN SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF' BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOT 9, BLOCK 3 OF THE LINDSEY AND HARVEY ADDITION, LOCATED AT 217 MOORE STREET, FROM "D" (MuLTIFAMILY) TO "c" (COMMERCIAL). Mr. Breihan moved the Ordinance be approved on second reading. Mr. Hansen seconded I the motion, which passed unanimously. The Mayor read the caption of an Ordinance as follows': AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION TWO OF THAT ORDINANCE, WHICH PROVIDES FOR A JOB CLASSIFICATION AND SALARY SCHEDULE FOR THE PUBLIC SAFETY DIVISION OF THE CITY OF SAN MARCOS. Mr. Hansen moved the Ordinance be adopted on third and final reading. Mr. James seconded the motion. On roll call, the following vote was recorded: AYE: Breihan, Craddock, Arredondo, Hansen, James NAY: Sutton, Cavazos.
