<br />ORDINANCE NO. 1977 _-45
<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING AND
<br />ADOPTING AMENDMENT NO. 5 TO THE URBAN
<br />RENEWAL PLAN FOR N.D.P. PROJECT TEX. A"6,
<br />DIRECTING THAT SAID CHANGE BE FILED AS
<br />PART OF THE URBAN RENEWAL PLAN FOR SAID
<br />PROJECT, AND PROVIDING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City has adopted a Redevelopment Plan known as,
<br />the Urban Renewal Plan for N.D.P. Project Tex. A-6" Final Action
<br />Year; and,
<br />
<br />WHEREAS, Amendment No. 5 to said Plan has been proposed for
<br />the purpose of effectuating a change in land use ;!idlr that certain
<br />tract described in Exhibit "B" attached hereto, and made a part
<br />hereof, said certain tract being within the boundary of the Tex. A-6,
<br />Neighborhood Development Prog.ram area, from "Public" use to "Commer-
<br />cial" use as defined by said Plan; and,
<br />
<br />WHEREAS, said Amendment No.5 has been submitted to and approved
<br />by the Board of Commissioners of the Urban Renewal Agency of the
<br />City of San Marcos, Texas, by Resolution dated July 5, 1977; and,
<br />
<br />WHEREAS, in addition, said Amendment No, 5 has been submitted
<br />to the Planning and Zoning Commission of the City of San Marcos
<br />and received its favorable recommendation and said recommendation
<br />has been forwarded to this body; and,
<br />
<br />WHEREAS, said {nan, as amended, will ,conform to the general
<br />plan for redevelopment of the City as a whole; and,
<br />
<br />WHEREAS, the provisions 6di the Texas Urban Renewal Law, Article
<br />lZ69L-3, Section 7e of the Vernon's Annotated Civil Statutes of
<br />Texas regarding modifications in Urban Renewal plans have been compliedl
<br />with.

<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, THAT:
<br />
<br />SECTION 1. Amendment No.5, consisting of one page of text,
<br />Land Use Map 3AAA (attached hereto as Exhibit "A"), and an
<br />accompanying survey (as Exhibi t "B"), which changes the land
<br />use for a certain parce 1 of land, as des cri bed thereon, from
<br />"Public" use to "Commercial" use as part of the Urban Renewal
<br />Plan for the Tex. A-6, N.D.P., is hereby ratified, adopted
<br />and approved.

<br />SECTION 2. Amendment No.5 is attached hereto and madel'!
<br />a part hereof.
<br />
<br />SECTION 3. The City Secretary is hereby directed to
<br />maintain a copy of said Amendment No.5 on file in her records
<br />as public notice of the change in the Redevelopment Plan for
<br />N,D.P. Project Tex. A-6, Final Action Year, and said Amend.-
<br />ment shall be binding on all redevelopers within the said
<br />project area.
<br />
<br />SECTION 4. This Ordinance shall become effective on the
<br />11th day following the date of due legal process and publi-
<br />cation in a newspaper of general circulation in the area.
