THE STATE OF TEXAS THE COUNTY OF HAYS LEASE AGREEMENT KNOW ALL MEN BY THESE PRESENTS: I That the City of San Marcos, Texas, a municipal corporation under the laws of the State of Texas, acting by authority of Resolution 1979- , adopted by the City Council of said City on October 8, 1979 , hereinafter referred to as "City" and Texas National Air Race, Inc. hereinafter referred to as "Lessee" enter into this lease agreement for the mutual benefit of the parties consisting of the following terms and conditions: I. City hereby grants Lessee permission to use that real property owned by City and known as the San Marcos Municipal Airport, consisting of concrete aprons, runways and airspace, for a period of two (2) days during the years 1980, 1981, .1982, 1983 and 1984. Lessee shall be allowed to use said I premises in each of the listed years from 12:00 a.m. on the fourth day of July until 12:00 a.m. on the sixth day of July. Sufficient time not to exceed three (3) days prior to and three (3) days after shall be allowed for assembly and dis- assembly of facilities. If all parts of this agreement have been met, the Lessee, at his option, may extend this lease for an additional five (5) calendar years to .1989. Notification to City of Lessee's intention to extend lease must be made in writing and received by Cilty:... by July IS, 1984. II. It is agreed that permission to use the property herein granted to Lessee is for the purpose of conducting air shows/ I races. III. As consideration for use of those premises known as San Marcos Municipal Airport for the described two (2) day period during the years listed in Part I, Lessee agrees to
