68 OP-DliWINCE43; I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ACCEPTING THE BID OF JAMES HOWARD TIDWELL AND BARBARA TIDWELL FOR THE PURCHASE OF PART OF LOT NO. 6 IN BLOCK 2 OF THE LINDSAY AND HARVEY ADDITION TO THE CITY OF SAN MARCOS, TEXAS; FURTHER DESCRIBED IN EXHIBIT A ATTACHED HERETO; AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL WARRANTY DEED TO SAID BIDDER ON BEHALF OF THE CITY OF SAN MARCOS, IN TRUST, FOR ITSELF, THE STATE OF TEXAS, THE COUNTY OF HAYS, AND THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos acquired all that right, title, and interest, conveyed by Sheriff's Deed, dated October 6, 1959, in and to a part of Lot 6, Block 2 of the Lindsay and Harvey Addition to the City of San Marcos, said lot being more particularly described on Exhibit "A" attached hereto, as trustee for itself, the State of Texas, the County of Hays, and the San Marcos Consolidated Independent School District; and, WHEREAS, said lot was not redeemed by its former owners within the statutory period; and, WHEREAS, the bid by James Howard Tidwell and Barbara Tidwell was the highest and best responsible bid; now, therefore, I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the bid of James Howard Tidwell and Barbara Tidwell in the amount of $4,005.00 for part of Lot 6, Block 2 of the Lindsay and Harvey Addition to the City of San Marcos, Hays County, Texas, be accepted as the highest and best responsible bid. SECTION 2. That the Mayor of the City of San Marcos, John A. Hansen, or his successor, be, and is hereby, authorized to execute a special warranty deed to James Howard Tidwell and Barbara Tidwell for said property on behalf of the City of San Marcos, in trust for itself, the State of Texas, the County of Hays, and the San Marcos Consolidated Independent School District. SECTION 3. That this Ordinance shall be in full force and effect ten (10) days from and after its passage by this body. PASSED AND APPROVED on first reading September 24, 1979.
