<br />68 <br /> <br />OP-DliWINCE43; <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />ACCEPTING THE BID OF JAMES HOWARD <br />TIDWELL AND BARBARA TIDWELL FOR THE <br />PURCHASE OF PART OF LOT NO. 6 IN <br />BLOCK 2 OF THE LINDSAY AND HARVEY <br />ADDITION TO THE CITY OF SAN MARCOS, <br />TEXAS; FURTHER DESCRIBED IN EXHIBIT <br />A ATTACHED HERETO; AUTHORIZING THE <br />MAYOR TO EXECUTE A SPECIAL WARRANTY <br />DEED TO SAID BIDDER ON BEHALF OF THE <br />CITY OF SAN MARCOS, IN TRUST, FOR <br />ITSELF, THE STATE OF TEXAS, THE <br />COUNTY OF HAYS, AND THE SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of San Marcos acquired all that right, <br />title, and interest, conveyed by Sheriff's Deed, dated October 6, 1959, <br />in and to a part of Lot 6, Block 2 of the Lindsay and Harvey <br />Addition to the City of San Marcos, said lot being more particularly <br />described on Exhibit "A" attached hereto, as trustee for itself, <br />the State of Texas, the County of Hays, and the San Marcos Consolidated <br />Independent School District; and, <br /> <br />WHEREAS, said lot was not redeemed by its former owners within <br />the statutory period; and, <br /> <br />WHEREAS, the bid by James Howard Tidwell and Barbara Tidwell <br />was the highest and best responsible bid; now, therefore, <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the bid of James Howard Tidwell and Barbara <br />Tidwell in the amount of $4,005.00 for part of Lot 6, Block 2 of <br />the Lindsay and Harvey Addition to the City of San Marcos, Hays <br />County, Texas, be accepted as the highest and best responsible bid. <br /> <br />SECTION 2. That the Mayor of the City of San Marcos, John A. <br />Hansen, or his successor, be, and is hereby, authorized to execute <br />a special warranty deed to James Howard Tidwell and Barbara Tidwell <br />for said property on behalf of the City of San Marcos, in trust for <br />itself, the State of Texas, the County of Hays, and the San Marcos <br />Consolidated Independent School District. <br /> <br />SECTION 3. That this Ordinance shall be in full force and <br />effect ten (10) days from and after its passage by this body. <br /> <br />PASSED AND APPROVED on first reading September 24, 1979. <br />PASSED AND APPROVED on second reading October 2, 1979. <br />PASSED, APPROVED AND ADOPTED October 8, 1979. <br /> <br />I <br /> <br />~ C;!/~ <br /> <br />( Uohn A.
