Mr. Tenorio noted that the public <br />hearing on the requested zoning had been held on October 22nd. <br />The City Manager reported to the Council that in response to numerous <br />Hughson Heights citizen concerns about additional development in the <br />area, he had met with representatives of those citizens and with the <br />developers of Hughson Heights Addition #2. As a result of those <br />meetings, Mr. Gonzalez said, certain staff recommendations concerning <br />traffic, density of development and utility service were being <br />presented to the Council. These recommendations are attached and made <br />a part of these minutes. Mr. Hyatt stated his concern that increasing <br />the cost of Bishop St. improvements to make the street match up with <br />North LBJ Dr. would mean that the entire Bishop St. improvement project <br />could not be completed. The City Manager advised the Council that the <br />project as currently proposed was under funded and that ata later date <br />the Council would have to consider additional revenue sources. Mr. <br />Breihan recommended that the project be bid with the Bishop St./LBJ <br />intersection as an alternate item. Mr. Gonzalez said that the staff <br />could present cost estimates and a time schedule for implementation of <br />the staff recommendations, with the exception of the actual Bishop St./ <br />N. LBJ intersection, by the next regular City Council meeting on <br />December 10th. Mr. Garland Stokes informed the Council that he and <br />Mr. Hughson would agree'to loop Sierra Vista Drive with Algarita Court so , <br />as to divert traffic flow into Hughson Drive as recommended by the <br />staff. In response to a question by Mr. Tenorio, Mr. Stokes also informed <br />the Council that future development in Hughson Heights would conform <br />to any changes that might be made in a revised master plan. On roll <br />call the motion to approve the zoning ordinance on first reading <br />passed with the following vote: <br /> <br />AYE: Tenorio, Breihan, Cavazos, Hyatt, Hansen, James <br /> <br />NAY: None <br /> <br />ABSTAIN: Sutton <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS <br />OF THE SALE BY THE CITY OF SAN HARCOS, TEXAS, OF <br />ONE-HALF OF PARCEL 12-2, DESCRIBED FURTHER BY METES <br />AND BOUNDS ATTACHED HERETO, LOCATED WITHIN THE TEX. <br />A-6, NEIGHBORHOOD DEVELOPMENT PROGRAH AREA, TO KOHUT <br />& COLE; AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY <br />DEED TO KOHUT & COLE; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved the ordinance be approved on second reading. Mr. <br />Hyatt seconded the motion which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITV COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE <br />LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING <br />THE ZONING OF APPROXIMATELY 1.167 ACRES OUT OF <br />THE T. J. CHAMBERS SURVEY FURTHER DESCRIBED BY <br />METES AND BOUNDS IN THE ATTACHED EXHIBIT A LOCATED <br />AT 1244 NORTH LBJ DRIVE FROM R-l (SINGLE FAMILY <br />RESIDENTIAL) TO D (MULTI-FAMILY). <br /> <br />Mr. Breihan moved the ordinance be adopted on third and final <br />reading. Mr. Hyatt seconded the motion. Mr. George Roberts, the <br />applicant, was present at the meeting. Mr. Tenorio, referring to <br />staff comments which recommended the City Council disapprove the <br />rezoning "unless a IS' wide strip of land is dedicated to the City <br />for future widening of North LBJ Dr.", said that he understood such <br />an action to be illegal and that he flet the staff should be directed <br />to refrain from imposing such requirements.
