191

137

regular meeting

december 17, 1979

page six

to pay a portion of the cost of utilities extension. Mr. Tenorio
agreed that he had reservations about the apparent conflict in
City policy. The City Manager informed the Council that the earlier
report that replacement of a portion of an 8" line would be necessary
to serve International Electric Corporation properly was inaccurate.
It was confirmed by Mr. Cooper Slay, President of International
Electric Corporation, that the only requirements for water service
were the extension of the 12" main from Lowman Field to the Inter-
national Electric site and a booster pump. Mr. Gonzalez told the
Council that the staff had contacted property owners in the area
and requested them to consider payment of a portion of the expenses
over the budgeted amount, but had received no confirmation that such
a cost sharing program would be possible except from International
Electric. Mr. Slay advised the Council that he had agreed it might
be possible for International Electric to pay for the cost of extending
the water line running along the front of his property, but that no
discussion had taken place concerning extension of the sewer line.
Mr. Hyatt moved to amend the original motion to state that between
the present time and the time the bids were to be approved on January
7th the Mayor and the Mayor Pro-Tem were authorized to work with
staff and International Electric Corporation representatives on identify in'
funds available to construct the necessary utilities. Mr. Tenorio
seconded the motion with the understanding that the Mayor and himself
would not be involved in individual negotiations with property owners,
but would instead analyze City budgets to see if additional funds could
be located from that source. The motion to amend passed unanimously.
Following that roll call, the Mayor called for a vote on the original
motion to authorize bids to be awarded by Council on January 7th. That
motion also passed unanimously.

I

The meeting recessed to executive session at 11:18 p.m. on motion
of ~1r. James and second of ~1r. Hyatt. The meeting reconvened at I
11:38 p.m. on motion of Mr. Hyatt and second of Mr. James. Mr.
Hyatt moved to authorize the City Attorney to settle a case of pendin
litigation at a dollar amount established in the executive session.
Hr. Tenorio seconded the motion. On roll call, the following vote
was recorded:

NAY:

Sutton, Tenorio, Breihan, Cavazos, Hyatt, Hansen
Jimfs ''/4 IE 0
~~ ~

AYE:

A'3'G'I'AIN.

,Jalh~3

The meeting adjourned at 11:43 p.m. on motion of Mr. James and second
of Mr. Hyatt.

4~

') /J /
i'24J 01-v,a'?14LIr-
ohn A.
