<br />: I(/{ <br /> <br />I <br /> <br />regular meeting, september 24, 1973 <br /> <br />page four <br /> <br />~y ../- <br />~i",t{1(::"~"~ J <br />..,.... <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF <br />BLOCK 43 OF THE VICTORY GARDENS SECOND ADDITION, LOCATED AT 1228 <br />LH. 35 SOUTH, FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL). <br /> <br />Mr. DeLa Rosa moved the Ordinance be approved on third reading. Dr. Tauch <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Cunn~ngham, DeLa Rosa, Dibrell, Etheredge, Flores, King, Tauch <br />None <br /> <br />I <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />Mr. Etheredge announced that two nominations had been made for the <br />Planning and Zoning Commission, and directed Councilmen to vote by secret <br />ballot for Lyndon Mellinger or Stanley Ault. The ballots were canvassed <br />by the City Manager and City Secretary. Mr. Ault received the majority <br />of the votes and was appointed Planning and Zoning Commissioner. <br /> <br />Mrs. Jack N. Stovall presented a quarterly report on the activities of <br />the Bicentennial Commission, completing it with a request for a flagpole <br />to be placed in Juan Veramendi Plaza so that the Bicentennial Flag might <br />be displayed there. Mr. Flores moved that the flagpole be provided and <br />placed in the Plaza. Mr. King seconded the motion, which passed unanimously. <br /> <br />Mayor Etheredge informed Councilmen that the October 1 workshop would be <br />held in the Student Union Building at Southwest Texas State University. <br /> <br />Jerri Martin called the Council's attention to Section 3.09 of the Charter <br />of the City of San Marcos which provides for meetings to be held in closed <br />session, but which stipulates "that final action thereon shall not be taken <br />by the Council until the matter is placed on the agenda." Mrs. Martin <br />related this to the earlier announcement that the city attorney and I <br />municipal court judge had been appointed in executive session. Mayor <br />Etheredge stated that this had been the policy in the past. Mr. King <br />moved to vote for city attorney by secret ballot. Mr. DeLa Rosa seconded <br />the motion. On roll call, the following vote was recorded: <br /> <br />AYE: DeLa Rosa, Dibrell, Etheredge, King, Tauch <br />NAY: Cunningham, Flores <br /> <br />Councilmen then voted on the appointment of city attorney by secret ballot. <br />The ballots were canvassed by the City Manager and City Secretary, and were <br />unanimously in favor of the appointment of Thomas Akins as city attorney. <br /> <br />Councilman Flores moved that legal advice be obtained on the proper method <br />of voting. Mr. Cunningham seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: Cunningham, Dibrell, Etheredge, Flores, King, Tauch <br />NAY: DeLa Rosa <br /> <br />Mr. DeLa Rosa moved to vote by secret ballot for the appointment of the <br />municipal court judge. Mr. King seconded the motion. Mr. Cunningham moved <br />to table the matter until legal counsel could be obtained. Mr. Flores <br />seconded the motion.
