1/ REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOVEMBER 8,1971 Present: Mayor Herbert A. Yarbrough, jr. COllncilmen: Guillermo DeLa Rosa Frances D. Emery Eddy A. Etheredge Luciano H. Flores Ross King David R. Ta~ch I City Manager City Secretary 'Mark E. Gresham Dorbthy o. Worrell The Mayor called the meeting to order at 7:30 p.m. and gave the Invocation. Minutes of the October 26 meeting were approved as presented, on motion of Mr. Etheredge and second of Dr. Tauch. I The Mayor opened a public hearing on a request for rezoning of a 9-acre tract ori Interstate 35 North. Mr. R.F. Lovela~e is owner of the property. Dr. Stanley Sissom, member of the Planning u Zoning Commission, said the origi~al request ~as for rezoning from "R-1"(residential) to "C" (commercial) on his entire property at that location. The Commission persuaded him to revise his request, as proposed for the hearing. No one else came forward to speak for or against the request for rezoning. The Mayor declared the public hearing closed. Mr. Yarbrough introduced and read aloud an ordinance with the following caption: AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, .1966 (VOL. 32) BY CHANGING THE ZONING OF A 9-ACRE TRACT OUT OF J.M. VERAMENDI LEAGUE #2: ~SECTION TO THE DEPTH OF 500 FEET WHICH FACES ON IH 35 FROM "R-1" (SINGLE~FAMILY RESIDENTIAL) TO "C" (COMMERCIAL); AND THE REMAINDER OF THE 9-ACRE TRACT, ADJOINING TO THE EAST, FROM "R-1" TO "D" (MULTI-FAMILY) Mr. King moved approval of the ordinance on first reading. Dr. Tauch seconded the motion, which' passed unanimously. The Mayor introduced an ordinance with the following caption: I AN ORDINANCE PROVIDING FOR A BUILDING CODE TO GOVERN THE CONSTRUCTION, ALTERATION, REMOVAL, DEMOLITION, EQUIPMENT, USE AND OCCUPANCY, AND THE MAINTENANCE @F BUILDINGS AND STRUCTURES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A SAVINGS CLAUSE; ESTABLISHiNG PENALTIES FOR VIOLATIONS; AND DECLARING AN EMERGENCY Mr. King moved adoption of the ordinance as an emergency. Mr. Flores seconded the motion and on roll call, th~ following vote was recorded: AYE: DeLa Rosa, Emery, Etheredge, flores. King, Yarbrough, Tauch NAY: None The Mayor declared the ordinance Passed, Approved and Adopted.
