<br />KNOW ALL MEN BY THESE PRESENTS:

<br />THAT WHEREAS, Shaw P. Breeding did grant to the City of San
<br />Marcos, a municipal corporation situated in Hays County, Texas, a
<br />certain twenty (20) foot wide easement on and across the Shaw P.
<br />Breeding property located between the City of San Marcos sewage
<br />treatment plant and the Blanco River, which easement was granted
<br />for the purposes of constructing and maintaining a sewage outfall
<br />line from the treatment plant to the Blanco River, as evidenced
<br />by .that certain deed dated July 18, 1951;
<br />THAT WHEREAS, said above-referenced deed from the said Shaw
<br />P. Breeding to the City of San Marcos, Texas, contains no adequate
<br />legal description setting forth the exact location of the easement
<br />on this property;
<br />THAT WHEREAS, it is to the benefit of both the City of San
<br />Marcos, Texas, and the present owner of the property formerly owned
<br />by Shaw P. Breeding to adequately define, in legal terms, the exact
<br />location of this easement, there having been recently made a survey
<br />of this easement;
<br />THAT WHEREAS, the City Council of San Marcos, Texas, did
<br />have a regular meeting, a quorum being present, on the ~ day of
<br />February , 1972, and passed an ordinance to quitclaim all of the
<br />right, title, interest, claim and demand of the City of San Marcos,
<br />Texas, in and to a certain tract of land hereinafter described, so
<br />as to adequately describe by proper legal description that easement
<br />granted to the City of San Marcos, Texas, in the above mentioned
<br />conveyance dated July 18, 1951, and recorded in Volume 13
<br />Pages 99-100 ;
<br />NOW, THEREFORE in consideration of the sum of One and nollOO
<br />($1.00) Dollar cash paid to the City of San Marcos, Texas, in hand
<br />paid by S. M. Enterprises, Inc., the receipt of which is hereby ack-
<br />nowledged, we, the undersigned officers, authorized by ordinance
<br />passed by the City Council of San Marcos, Texas, on behalf of the
<br />City, have quitclaimed and by these presents do quitclaim, unto the
<br />said S. M. Enterprises, Inc. all of the right, title, i~terest,
<br />claim and demand in and to those certain tracts of land,with the
<br />exception of said easement as hereinafter described by metes and
<br />bounds, situated in said County of Hays, bounded and described as
<br />follows:

<br />TWO (2) TRACTS OF LAND OUT OF THE J. M. VERAMENDI LEAGUE IN HAYS
<br />COUNTY, TEXAS, THE TRACT OF LAND HEREINAFTER DESCRIBED AS TRACT NO.1,
<br />BEING A PART OF THAT TRACT OF LAND DESCRIBED AS FIRST TRACT IN A DEED
<br />TO SHAW P. BREEDING OF RECORD IN VOLUME 137 AT PAGE 187 DEED RECORDS
<br />OF HAYS COUNTY, TEXAS, AND THE TRACT OF LAND HEREINAFTER DESCRIBED
<br />AS TRACT NO. 2 BEING ALL OF THAT TRACT OF LAND DESCRIBED AS SECOND
<br />TRACT IN THE ABOVE MENTIONED DEED, AS THE SAME IS PRESENTLY USED,
<br />FENCED AND OCCUPIED ON THE GROUND, THE TRACT OF LAND HEREINAFTER
<br />DESCRIBED AS TRACT NO.1 CONTAINING 64.36 ACRES AND THE TRACT OF LAND
<br />HEREINAFTER DESCRIBED AS TRACT NO.2 CONTAINING 3.69 ACRES, EACH OF
<br />THE SAID TRACTS OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES
<br />AND BOUNDS AS FOLLOWS:

<br />TRACT NO.1: BEGINNING at an iron stake found in the north fence
<br />line of the M. K. & T. ~ailroad Right-of-Way at the
<br />southwest corner of a one (1) acre tract of land described in a deed
<br />of record in Volume 214 at Page 214-218, Deed Records of Hays County,
<br />Texas;
<br />
<br />THENCE with the north right-of-way lien of the M. K. & T. Railroad,
<br />as fenced, the following four courses:
