Mr. Etheredge stated his <br />concern with Section 15.1 of the Ordinance which he felt created <br />a situation that would not allow a private c~tizen to make use of <br />the low cost or free choice of a.mobile home. Dr. Tauch asked if <br />this amendment would delete the temporary mobile home permit from <br />the Ord i nance" The City Manager answered aff i rmat i ve I y. Mr. <br />Yarbrough said he felt the City needed some criteria .for the <br />development of the mobile home park situation and orderly land <br />usage. On 1'01 I cal I,thefol lowing vote was recorded: <br /> <br />I <br /> <br />AYE: Cunningham, DeLa Rosa, Flor,s, King, Tauch, Yarbrough <br /> <br />NAY: Etheredge <br /> <br />The Mayor deelared the Ordinance passed on first reading. <br /> <br />The M~yor opened a Public Hearing on an Ordinance amending the <br />Zoning Ordinance to provide land use classifications for "o~-premises" <br />consumption of I iquor, wine .01' beer. Mr. King moved the Council <br />consider the "restaurant" version of theOrdi~ance. Mr. Yarbrough <br />seconded th~ motion, which passed unanimously. The Mayor read the <br />caption. Those recognized by *he Counci I who commented on the <br />Ordinance included Mrs. Linda Gilchrist, Mrs. Jack Weatherford <br />of the ,P I ann i ng and Zoni ng Comm i ss i on, Jack Brown, Joe ,Gonza I es, <br />Jul ian Gonzales and Ramiro Lugo. Following the discussion, the <br />Mayor declared the Publ ic Hearing closed. <br /> <br />The Mayor introduced an ,Ord i nance with the fo II ow i ng capt i on: <br /> <br />I <br /> <br />AN ORDINANCE AMENDING APPENDIX."A" OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED <br />"GENERAL ZONING ORDINANCE", BY THE ADDITION TO <br />SECTION 11 THEREOF OF A SUB-SECTION (TO BE NUMBERED 13) <br />FORBIDDING ESTABLISHMENTS WHICH DISPENSE LIQUOR, WINE <br />OR BEER WITHIN AN"M" SINGLE, DUPLEX, MULTI,PLE FAMILY <br />DWELLING AND NEIGHBORHOOD BUSIN~SS DISTRICT; AND BY THE <br />ADDITION TO SECTION 13 THEREOF OF A SUB-SECTION (TO BE <br />NUMBERED 3) ALLOWING RESTAURANTS OR CAFES WHICH DISPENSE <br />LIQUOR, WINE OR BEER FOR ON-PREMISES CONSUMPTION UNDER <br />PERMIT BY THE STATE OF TEXAS WITHIN A COMMERCIAL DISTRICT <br />"C~; A~D BY'THE ADDITION TO SAID ORDINANCE OF ANEW ' <br />SECTION (TO BE DESIGNATED SECTION 13.1 COMMERCIAL DISTRICT <br />C-Z) ALLOWING ESTABLISHMENTS OTHER THAN RESTAURANTS OR <br />CAFES WHICH DISPENSE LIQUOR, WINE OR BEER FOR ON-PREMISES <br />CONSUMPTION BY PERMIT OF THE STATE OF TEXAS; AND DECLARING <br />AN EMERGENCY <br /> <br />Mr. King moved the Ordinance be passed on an emergency basis. <br />Mr. Yarbrough seconded the motion, and on roll cal I, the fol lowing <br />vot,e was recorded; <br /> <br />AYE: Cunningham, DeLa Rosa, Flores, King, Tauch, Yarbrough <br /> <br />I <br /> <br />NAY: None <br /> <br />ABSlA]N~ Etheredge <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br />
