(b) One of said twenty persons was not a qual ified <br />. voter within the City of San Marcos and, also had not signed <br />the petition itsel f.' (c) No particular signature on said <br /> <br />petition was declared to have been placed thereon in the presence <br />of any particul ar one of said twenty persons. (d) That said <br />oath nowhere declares the statements in the petition to be true <br />or that each signature on the petition is genuine. <br /> <br />The City Secretary and Deputy Secretary proceeded with check- <br />ing the signatures on the petition, with the result that out <br />of 728 names, 574 were found to be valid, and 154 not val id. <br />The City Attorney determined t~at 320 valid signatures were <br />needed for a petition initiating legislation. <br /> <br />I <br /> <br />Reference is made to Article VI, Section 6.04 of the Charter: <br />"After completing examination of the petition, the Secretary <br />shall certify the result thereof to the Council at its next <br />regular meeting. If the certificate of the City Secretary <br />shall show an initiative or referendum petition to be insuffi- <br />cient, the Secretary shall notify the person fil ing the petition..." <br /> <br />Therefore, acting upon the advice of the City Attorney, the <br />City Secretary hereby certifies that the petition is insufficient <br />for the reasons given above, and she will so notify Rodger M. <br />Zimmerman, legal counsel retained by the City's Parks & Recreation <br />Board. <br /> <br />Respectfully submitted this 24th day of July, 1972. <br /> <br />~~y~~a~ <br /> <br />City s:ery <br /> <br />I <br />
