TEXAS 78866 <br /> <br />AC 512 EX2""3306 <br /> <br />February 5, 1971 <br /> <br />Mr,Richard Bean <br />City Manager <br />City of San Marcos <br />San Marcos, Texas 78666 <br /> <br />Dear Richard: <br /> <br />Inclosed will be found petition to the City <br />to close and abandon a portion of Matthews Street. <br />You will note that it is signed by Eugene F, Morrow, <br />J. Garland Warren and John M. Pool, <br /> <br />Mr, Warren informs me that the only other <br />property owners in position to complain about such <br />closing and abandonment are Mr, Ross Bagley and <br />Southwest Texas State University. Further, he says <br />he has contacted both such property owners. <br /> <br />He says that Mr. Bagley refused to sign the <br />petition, on the ground that it might prejudice exit <br />from and entrance to his property. This despite the fact <br />that his property presently borders another street <br />(Chestnut or LBJL' <br />(Warren) <br />He/says that he contacted Mr. Jack Cates of <br />the University, not to get him to sign the petition <br />but merely to determine wgether Mr. Cates felt the <br />UniversitFwould be opposed to the move. Mr. Warren <br />says that Mr. Cates stated he would investigate the <br />matter and give his opinion thereafter. <br /> <br />Now, granted that Mr. Cates does not be- <br />live the University will oppose the abandonment and <br />closing, we still must bear in mind the possibility <br />that Mr. Bagley may file a suit to try to prevent the <br />move. Therefore, the Council should have this possibility <br />in mind prior to making its decision in this regard, <br /> <br /> <br />!, <br />
