I WHEREAS, in HAYS COU1TIrl on LOOP 82, the City of San }rorco~ has requested assist- ance in the widening of pavement and Son Marcos River >>ridge including incidental HCClS thereto from near tho entrance to Aquarena Sprints to near !loon Street. a distance of approximately 0.8 mile; and WHEREAS, an flnalysb of the requested work indicates that such widening will lIIIlte- rially add to traffic safety on this facilitYi NOW, THEREFORE, tha State Higbway Ensineor is directed to tender the follollinS proposal to the City of San Marcos: lrovided the City will: 1. Provide for the construction of continuous curb and gutter, utility adjustmeats, storm sewers, etc., all as may be necessary for a c~ plete project with the exception of pavement and its support and San Marcos River Bridge. . 2. ASsume responsibility for th~ construction of driveways and sidewalk. '.hould they be deemed necessary now or in the future and agree to ~ake such installations in accordance with governing policies and reguletionsof the Department., 1- I 3. Maintain that portion of the york which is its responsibility in accordance with present maintenance agreement, and agree to regulate traffic, prohibit all parking and prevent encroachment on the right of way, all in accordance with governing policies ~nd regulations oft' the Department. ' . t~.~ I;: The Texas Highway Department will: t~.. :'~,. .; 1. Provide for widening pavement and its support and San Marcoa River Bridge within these limits in a future progrsm of work. 2. Maintain that portion of the work whicb is its responsibility in accordance with present maintenance agreement.. ;.. -1" It 18 undetstood that the responSibility of tbe Tex88 Highway Department is. con- fined to the pavement and its support, and all other features necessary now or in the future to provide an adequate travel facility shall be the responsibility .! of the City of San Marcos. I Upon scceptance of the provisions of this Order by the appropriate officials of tne City of San Marcos the State Highway Engineer is directed to proceed with the development of plans end when the City has fulfilled its obligations under this Order and when plans are com~lete, the State Highway Rnzineer shall submit the work for financo consideration of the Highway Commission in the next available pro&ram of work. It is understood that the City may discharge its construction obligations as out- lined herein in any manner as they may elect. In the event the City desires the State to inchlde their portion of the 'Worlt in the State's construction contract, the State Hi31may Engineer is hereby authorized to enter into a3roeroent with tbe Cit~ for such york and its cost as may be agreed upon. This Order shall become operative upon acceptance by tho City of San Marcos and if not accepted within 90 days of the date hereof, the action horein contained 8hall be automatically cancelled. l ...i.....
