I)..........t <br />!," ..:-".......ra .::ao.A <br />.. <br /> <br />, ,. <br /> <br />(J <br /> <br />I<cr'), <br />''''''''ie.. r.: .a.." <br /> <br />MINUTE ORDER <br /> <br />-BAYS <br />1>fatrlct No. 1 4 <br /> <br />COllDl7 <br /> <br />Pa..& <br /> <br />1 of <br /> <br />, , <br />2 Papa . <br /> <br />I <br /> <br />WHEREAS, in HAYS COU1TIrl on LOOP 82, the City of San }rorco~ has requested assist- <br />ance in the widening of pavement and Son Marcos River >>ridge including incidental <br />HCClS thereto from near tho entrance to Aquarena Sprints to near !loon Street. a <br />distance of approximately 0.8 mile; and <br /> <br />WHEREAS, an flnalysb of the requested work indicates that such widening will lIIIlte- <br />rially add to traffic safety on this facilitYi <br /> <br />NOW, THEREFORE, tha State Higbway Ensineor is directed to tender the follollinS <br />proposal to the City of San Marcos: <br /> <br />lrovided the City will: <br /> <br />1. Provide for the construction of continuous curb and gutter, utility <br />adjustmeats, storm sewers, etc., all as may be necessary for a c~ <br />plete project with the exception of pavement and its support and <br />San Marcos River Bridge. . <br /> <br />2. ASsume responsibility for th~ construction of driveways and sidewalk. <br />'.hould they be deemed necessary now or in the future and agree to <br />~ake such installations in accordance with governing policies and <br />reguletionsof the Department., <br /> <br />1- I <br /> <br />3. Maintain that portion of the york which is its responsibility in <br />accordance with present maintenance agreement, and agree to regulate <br />traffic, prohibit all parking and prevent encroachment on the right <br />of way, all in accordance with governing policies ~nd regulations <br />oft' the Department. ' . <br /> <br />t~.~ <br /> <br />I;: <br /> <br />The Texas Highway Department will: <br /> <br />t~.. <br />:'~,. <br />.; <br /> <br />1. Provide for widening pavement and its support and San Marcoa River <br />Bridge within these limits in a future progrsm of work. <br /> <br />2. Maintain that portion of the work whicb is its responsibility in <br />accordance with present maintenance agreement.. <br /> <br />;.. <br />-1" <br /> <br />It 18 undetstood that the responSibility of tbe Tex88 Highway Department is. con- <br />fined to the pavement and its support, and all other features necessary now or <br />in the future to provide an adequate travel facility shall be the responsibility .! <br />of the City of San Marcos. <br /> <br />I <br /> <br />Upon scceptance of the provisions of this Order by the appropriate officials of <br />tne City of San Marcos the State Highway Engineer is directed to proceed with the <br />development of plans end when the City has fulfilled its obligations under this <br />Order and when plans are com~lete, the State Highway Rnzineer shall submit the <br />work for financo consideration of the Highway Commission in the next available <br />pro&ram of work. <br /> <br />It is understood that the City may discharge its construction obligations as out- <br />lined herein in any manner as they may elect. In the event the City desires the <br />State to inchlde their portion of the 'Worlt in the State's construction contract, <br />the State Hi31may Engineer is hereby authorized to enter into a3roeroent with tbe <br />Cit~ for such york and its cost as may be agreed upon. <br /> <br />This Order shall become operative upon acceptance by tho City of San Marcos and <br />if not accepted within 90 days of the date hereof, the action horein contained <br />8hall be automatically cancelled. <br /> <br />l <br /> <br />...i..... <br />
