<br />RESOLUTION OF THE CITY OF SANMARCOSPROVID1NG AS- <br />SURANCES PURSUANT TO UNIFORM'RELOCATION ASSISTANCE <br />AND REAL PROPERTY ACQUISITIONPOLlcIES ACT OF 1970 <br /> <br />I <br /> <br />WHEREAS, the Uniform Relocation Assistance and Real Pro- <br />pertYAcquisition po1J.Gies AGt of 1970, P .L.91-646, (herein- <br />after referred, to as the "Act" ) establishes uniform policies <br />for the fair and equitable treatment of persons displaced as <br />a result of Federalandfederally assisted programs , as well <br />as uniform policies on real property acquisition practices with <br />respect to such programs; and <br /> <br />" WHEREAS ,the Act has application,toprogr~llis and projects <br />receiving financial assistance under Title I of the Housing <br />Act of 1949 for a code Enforcement project Or program desig- <br />nated as follows: Tex. E-l9; and <br /> <br />WHEREAS, the activities for which such assistance is <br />sought will involve displacement>andj6r land acquisition oc- <br />curring after January 2, 1971, the effective date of the Act; <br />and <br /> <br />WHEREAS, Sections 210 and 305 of the Actrequire the <br />provision of certain assurances before the head of a Federal <br />agency can approve any grant to, or contract or agreement <br />wi th, a State agency, under which Federal financial assistance <br />will ~e available, to pay all or part of any program or pro- <br />ject which will result in displacement or real property acqui- <br />sitionsubject to the requirements of the Act. <br /> <br />!I <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the governing body of <br />the City of San Marcos: That the United States of America <br />and the Secretary of Housing and Urban Development be, and <br />they hereby are, provided through the adoption of this reso- <br />lution, with the following assurances regarding conduct by <br />the City of San MarcOs of the project or program for which <br />Federal financial assistance under Title I of the Housing Act <br />of 1949 is sought. <br /> <br />l. Fair and reasonable relocation payments and assistance <br />shall be provided in accordance with sections 202, 203, <br />and 204 of the Act and applicable HUD regulations, to <br />or for families, individuals, partnerships, corpora- <br />tions or associations displaced';"asa result of the <br />instant project; <br /> <br />2. Relocation assistance programs offering the services <br />described in Section 205 of the Act shall be provided <br />to such displaced families, individuals, partnerships, <br />corporations or associations in the manner provided <br />under applicable Hun regulations; <br /> <br />I <br /> <br />3. Within a reasonable time prior to displacement, de- <br />cent, safe, and sanitary replacement dwellings will <br />be available to such displaced families and indivi- <br />duals in accordance with Section 205(c) (3) of the <br />Act; and <br /> <br />4. Affected persons will be adequately informed of the <br />benefits, policies and procedures provided in the <br />applicable BUD regulations (36 F.R. 8785 et seq" <br />May 13,1971); and ' <br />
