RESOLUTION OF THE CITY OF SANMARCOSPROVID1NG AS- SURANCES PURSUANT TO UNIFORM'RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITIONPOLlcIES ACT OF 1970 I WHEREAS, the Uniform Relocation Assistance and Real Pro- pertYAcquisition po1J.Gies AGt of 1970, P .L.91-646, (herein- after referred, to as the "Act" ) establishes uniform policies for the fair and equitable treatment of persons displaced as a result of Federalandfederally assisted programs , as well as uniform policies on real property acquisition practices with respect to such programs; and " WHEREAS ,the Act has application,toprogr~llis and projects receiving financial assistance under Title I of the Housing Act of 1949 for a code Enforcement project Or program desig- nated as follows: Tex. E-l9; and WHEREAS, the activities for which such assistance is sought will involve displacement>andj6r land acquisition oc- curring after January 2, 1971, the effective date of the Act; and WHEREAS, Sections 210 and 305 of the Actrequire the provision of certain assurances before the head of a Federal agency can approve any grant to, or contract or agreement wi th, a State agency, under which Federal financial assistance will ~e available, to pay all or part of any program or pro- ject which will result in displacement or real property acqui- sitionsubject to the requirements of the Act. !I NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of San Marcos: That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, provided through the adoption of this reso- lution, with the following assurances regarding conduct by the City of San MarcOs of the project or program for which Federal financial assistance under Title I of the Housing Act of 1949 is sought. l. Fair and reasonable relocation payments and assistance shall be provided in accordance with sections 202, 203, and 204 of the Act and applicable HUD regulations, to or for families, individuals, partnerships, corpora- tions or associations displaced';"asa result of the instant project; 2. Relocation assistance programs offering the services described in Section 205 of the Act shall be provided to such displaced families, individuals, partnerships, corporations or associations in the manner provided under applicable Hun regulations; I 3. Within a reasonable time prior to displacement, de- cent, safe, and sanitary replacement dwellings will be available to such displaced families and indivi- duals in accordance with Section 205(c) (3) of the Act; and 4. Affected persons will be adequately informed of the benefits, policies and procedures provided in the applicable BUD regulations (36 F.R. 8785 et seq" May 13,1971); and '
