I Court of the City of San Marcos or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respec- tively, be guilty of a misdemeanor, punishable by a fine of not less than Five and OOjlOO Dollars ($5.00) nor more than Two Hundred and OOjlOO Dollars ($200.00). The imposition of one penalty for any violation shall not excuse the violation or permit to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall consti- tute a separate offense. b. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. Section 14. Repeal of Conflicting Ordinances. All former ordinances or parts thereof conflicting or inconsistent with the provisions of this Ordinance or of the Code hereby adopted are hereby repealed. Section 15. Validity. The City Council of the City of San Marcos hereby de- clares that should any section, paragraph, sentence, or word of this Ordinance or of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council of the City of San Marcos that it would have passed all other portions of this Ordinance independent of the elimination here from of any such portion as may be declared invalid. I Section 16. Declaration of Emergency and Establishment of Effective Date of this Ordinance. The public health, welfare and safety being presently endangered, due to the facts that existing ordinances of this municipality not only do not afford adequate and com- prehensive regulations governing the prevention of fires but are also inconsistent with State statutes covering such subject, constitutes an emergency; therefore, the provisions of the Charter of the City of San Marcos, Texas, which ordi- narily require that ordinances shall be read on three several days and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage, shall be dispensed with. Thus, this ordinance shall be effective immediately upon its passage by the City Council and its subsequent publication in a newspaper of general circulation within the City of San Marcos, Texas.
