<br />I <br /> <br />Court of the City of San Marcos or by a court of competent <br />jurisdiction, within the time fixed herein, shall severally <br />for each and every such violation and noncompliance respec- <br />tively, be guilty of a misdemeanor, punishable by a fine of <br />not less than Five and OOjlOO Dollars ($5.00) nor more than <br />Two Hundred and OOjlOO Dollars ($200.00). The imposition of <br />one penalty for any violation shall not excuse the violation <br />or permit to continue; and all such persons shall be required <br />to correct or remedy such violations or defects within a <br />reasonable time; and when not otherwise specified, each ten <br />days that prohibited conditions are maintained shall consti- <br />tute a separate offense. <br />b. The application of the above penalty shall not be <br />held to prevent the enforced removal of prohibited conditions. <br /> <br />Section 14. Repeal of Conflicting Ordinances. <br /> <br />All former ordinances or parts thereof conflicting or <br />inconsistent with the provisions of this Ordinance or of the <br />Code hereby adopted are hereby repealed. <br /> <br />Section 15. Validity. <br /> <br />The City Council of the City of San Marcos hereby de- <br />clares that should any section, paragraph, sentence, or word <br />of this Ordinance or of the Code hereby adopted be declared <br />for any reason to be invalid, it is the intent of the City <br />Council of the City of San Marcos that it would have passed <br />all other portions of this Ordinance independent of the <br />elimination here from of any such portion as may be declared <br />invalid. <br /> <br />I <br /> <br />Section 16. Declaration of Emergency and Establishment of <br />Effective Date of this Ordinance. <br /> <br />The public health, welfare and safety being presently <br />endangered, due to the facts that existing ordinances of <br />this municipality not only do not afford adequate and com- <br />prehensive regulations governing the prevention of fires but <br />are also inconsistent with State statutes covering such <br />subject, constitutes an emergency; therefore, the provisions <br />of the Charter of the City of San Marcos, Texas, which ordi- <br />narily require that ordinances shall be read on three several <br />days and that no ordinance shall become effective until the <br />expiration of ten (10) days following the date of its final <br />passage, shall be dispensed with. Thus, this ordinance shall <br />be effective immediately upon its passage by the City Council <br />and its subsequent publication in a newspaper of general <br />circulation within the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this the 9th day of August, <br />1971. <br /> <br />/; <br />'/ ,I f""'j'/j!l / <br />(/'~:J L~&,~(~~t" \ <br />Herbert A.
