<br />september 13, 1971 <br /> <br />page three <br /> <br />I <br /> <br />Ted Breihan, owner ot the property, explained the background <br />of his acquisition of the land, and his appearances before <br />the Planning & Zoning Commission dur1ng the past several years <br />as he sought to develop the property. He said he had follow- <br />ed the advice ot some former members of the Commission, and <br />acquired additional property, to serve as a buffer zone. A <br />full discussion was held. The Mayor closed the Public Hearing <br />at 10:25 p.m. <br />Mr. Flores moved that the ordinance changing the zoning on <br />the Breihan property be tabled until the first meeting in October. <br />Mr. DeLa Rosa seconded the motion and on roll call, the following <br />vote was recorded: <br /> <br />AYE: DeLa Rosa, Etheredge, Flores, King, Tauch, Yarbrough <br />NAY: Emery <br /> <br />The Mayor declared the motion carried. <br /> <br />I <br /> <br />The Mayor opened a Public Hearing on a request for change of <br />zoning on Lot 4 & part of Lot 3, Block 1, West End Subidivison, <br />from -R-1 (single-tamily residential) to "M" (mixed). <br />Garland Warren, owner of the property, said he had tried to get <br />a change of zoning before, to build a drive-in grocery. At that <br />time, he was told it might interfere with plans for a loop <br />around the City which would connect with Bishop Street. He said <br />he had offered to give property to widen Bishop, if it were needed. <br />A number of people who own property within 200 feet of the Warren <br />property~~oke against the change. It was recalled that the Council <br />had recently asked the Planning & Zoning Commission to study the <br />advisability of establishing a commercial area in that same <br />neighborhood. This would avoid "spot zoning", which had been the <br />reason for turning down the request in the past. The Mayor closed <br />the Public Hearing at 10:45 p.m. <br />Councilman Etheredge moved that the request for change of zoning <br />be denied. Councilman Flores seconded the motion, which passed <br />unanimously. <br /> <br />The Mayor read an ordinance with the following caption: <br /> <br />AN ORDINANCE CLOSING AND ABANDONING AN ALLEY BETWEEN <br />HUTCHISON AND HOPKINS STREETS AND PARALLEL TO BOTH <br />COMANCHE AND 'FREDERICKSBURG STREETS, SUCH ALLEY f$EING <br />LOCATED IN BLOCK 14 OF THE ORIGINAL TOWN OF SAN MARCOS, <br />TEXAS; AND DIRECTING THE MAYOR TO EXECUTE AND DELIVER <br />QUIT-CtATM'DEEDS RELlNQUISTNG ALL RIGHT, TITLE AND INT- <br />EREST OF THE CITY OF SAN MARCOS IN SAID ALLEY TO THE <br />OWNERS OF REAL PROPERTY ADJACENT THERETO <br /> <br />Mr. Fi'o'':'es"fm6v~21' ~pproval of the ~~dinanc~ on second" reading <br />Mr. Etheredge seconded the motion, which passed unanimously. <br /> <br />The Mayor read an ordinance with the following caption: <br /> <br />I <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED MAY 23,1966 (VOL. 32) BY CHANG- <br />ING THE ZONING OF A 6-ACRE TRACT OUT OF THE J. VERAMENDI <br />SURVEY #2, FROM "R-1- (SINGEL-FAMILY RESIDENTIAL) TO "C- <br />(COMMERCIAL) <br /> <br />Mr. DeLa Rosa moved approval ot the ordihance on ~e~bnd reading. <br />Mr. King seconded the motion, which passed unanimously. <br />
