<br />I <br /> <br />I <br /> <br />I <br /> <br />;U <br /> <br />AN ORDINANCE REGULATING PARKING OF VEHICLES ON <br />THAT PORTION OF LOOP NO. 82~LSO KNOWN AS <br />COLORADO STREET) BETWEEN MOON AND SESSOMS DRIVE; <br />REPEALING ALL ORDINANCES IN CONFLICT; CONTAINING <br />A SEVERABILITY PROVISION; PROVIDING A PENALTY FOR <br />VIOLATION; AND FIXING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, it has been brought to the attention of the Governing <br /> <br />Body of the City of San Marcos that the portion of Loop No. 82 <br /> <br />(also known as Colorado Street) between Moon and Sessoms Drive, <br /> <br />in the City of San Marcos, Texas, is not of sufficient width to <br /> <br />permit the free passage of two-way traffic and, at the same time, <br /> <br />accommodate parking on either side thereof; and, <br /> <br />WHEREAS, the best interest of the public requires that parking <br /> <br />on the above-mentioned portion of said Loop 82 must be prohibited; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE <br /> <br />CITY OF SAN MARCOS, TEXAS: <br /> <br />Section I. It shall hereafter be unlawful to park <br />any vehicle on that portion of Loop 82 between Moon Drive <br />and Sessoms Drive. <br /> <br />Section 2. All ordinances and/or part of ordinances <br />in conflict herewith are hereby repealed. <br /> <br />Section 3. In the event any word, phrase, clause, <br />sentence, paragr~l or any other portion of this ordinance <br />shall be judicially determined to be unconstitutional, <br />ineffective or unlawful, such judicial holding shall not <br />affect the remaining portion hereof. <br /> <br />Section 4. Any person found guilty of violating this <br />ordinance, or any part thereof, shall be guilty of a mis- <br />demeanor, and, upon conviction shall be fined in the <br />amount not exceeding Two Hundred Dollars ($200.00). <br /> <br />Section 5. Tbat the public welfare and safety being <br />endangered due to the fact that the portion of Loop 82 <br />between Moon Drive and Sessoms Drive is not of sufficient <br />width to permit the free passage of two-way traffic and, <br />at the same time, accommodate parking on either side <br />thereof; therefore, as said portion of Loop 82 is heavily <br />travelled with parking thereon being a menace to the <br />public welfare and safety, an emergency exists, requiring <br />that the provisions of the Charter of the City of San <br />Marcos which provide that ordinances be read on three <br />several days and that no ordinance shall become effective <br />until the expiration of ten days following the date of <br />its final passage, be dispensed with at this time. Thus, <br />this ordinance shall be in full force and effect from and <br />after the date of its legal publication in a newspaper <br />having general circulation in the City of San Marcos, <br />Texas. <br /> <br />-1- <br />
