<br />I <br /> <br />AN ORDINANCE ABANDONING, DISCONTINUING AND CLOSING <br />THE STREET, ALLEY OR PUBLIC PASSAGEWAY DESIGNATED <br />AS "IVEY WAY" ON THE PLAT Of G.A. MacNAUGHTON FIRST <br />ADDITION TO THE CITY OF SAN MARCOS, IN HAYS CO~NTY, <br />TEXAS, AND RELINQUISHING TO SAN MARCOS BAPTIST <br />ACADEMY ALL RIGHT, TITLE AND INTEREST OF THE CITY OF <br />SAN MARCOS IN AND TO THE SAID IVEY WAY AND DIRECTING <br />THE MAYOR TO EXECUTE AND DELIVER TO SAN MARCOS BAPTIST <br />ACADEMY A QU IT -C LA 1M DEED TO THE SAI D PROPERTY DES IG- <br />NATED AS IVEY WAY <br /> <br />WHEREAS, on July 7, 1909, G.A. MacNaughton filed for record the <br />plat of a subdivision known as and called the G.A. MacNaughton <br />First Addition to the City of San Marcos, Texas, and such plat <br />being recorded in Volume 55, Page 593, Hays County Deed Records; <br />and the said plat and its said record are here referred to and <br />made a part hereof for all pertinent, legal and descriptive pur- <br />poses; and, <br /> <br />WHEREAS, the said plat created the subdivision known as G.A. <br />MacNaughton First Addition to the City of San Marcos, Texas, and <br />thereby dedicated to the use of the public each of the streets <br />and alleys shown on said plat, including the said Ivey Way; and, <br /> <br />I <br /> <br />WHEREAS, the said plat does not show on same any acceptance there- <br />of by the County of Hays or by the City of San Marcos nor have the <br />County of Hays or the City of San Marcos ever exercised, nor are <br />either of them now exercising any jurisdiction over any part of <br />the said Ivey Way, and no part of said Ivey Way has ever been grad- <br />ed, gravelled, paved nor in anywise bee'n used by the public as a <br />passageway, nor has the said Ivey Way ever been used by the City <br />of San Marcos, by the County of Hays or the public for any pur- <br />pose; and, <br /> <br />WHEREAS, San Marcos Baptist Academy is the owner of all the land <br />adjoining the said Ivey Way both on the northwest side and on the <br />southeast side thereof and San Marcos Baptist Academy has petit- <br />ioned the City of San Marcos to close, vacate, discontinue and <br />abandon the said Ivey Way and has petitioned the City of San Marcos <br />to quit-claim the said property to it, the said San Marcos Baptist <br />Academy: <br /> <br />NOW, THEREFORE, be it enacted and ordained by the City Council <br />of the City of San Marcos, Texas: <br /> <br />I <br /> <br />1. All of Ivey Way as shown on the plat of the G.A. <br />MacNaughton First Addition to the City of San Marcos, <br />be, and it is hereby abandoned, vacated, discontinued <br />and closed as a public street or alley of the City of <br />San Marcos, Texas. the said tract of land being 20 feet <br />wide and 770.27 feet long and containing 15,405.5 square <br />feet of land. <br /> <br />2. That the City of San Marcos, Texas, relinquishes hereby <br />to San Marcos Baptist Academy all right, title and <br />interest of the City of San Marcos, Texas, in and to <br />the said street or alley, and, further, that the Mayor <br />of the City of San Marcos, Texas, is hereby authorized, <br />empowered and directed to execute and deliver to the <br />said San Marcos Baptist Academy a quit-claim deed to <br />
