Rogers, Mr. & Mrs. Milton <br />Rogers, Bill Veidt <br /> <br />The Mayor called the meeting to order at 4:00 p.m. <br /> <br />The Mayor announced that the resignation of Councilman Dannelley, <br />effective February 28, 1970, required an amendment to the Election <br />Orders passed February 9, to fill the unexpired term for <br />Councilman, Place 1. The Mayor read the caption of the Amendment, <br />which is attached as a part of the Minutes. Mr. Flores moved <br />adoption of the Amendment to the Election Orders. Mr~ Contreras <br />seconded the motion, which passed unanimously. <br /> <br />Mr. Bean opened discussion on a matter of title to righ~-of-way <br />on Linda Drive. Copies of a 1958 letter to Milton B. Rogers from <br />the then City Manager, and of a letter of request from Mr~ Rogers <br />to the present City Council are attached as a part of the Minutes. <br />Mr. Bean stated an exhaustive and unsuccessful search had been made <br />for the deed to the right-of-way in Block 9, which Mr. Rogers <br />said he executed. Deeds to the other rights-of-way for Linda Drive <br />(in Blks. 6,7 & 8) are recorded. The matter was thoroughly discussed. <br />It was brought out that the request was for paving, only, and not <br />for curb and gutter. The City Manager said, should the City now <br />enter into an agreement with Mr. Rogers, a stipulation should be <br />included that the City would pave the street only once. and that <br />should another project be initiated, at some time in the future, <br />the property-owner would then participate in the paving cost, like <br />other property-owners on Linda Drive. <br />Dr. Craddock moved that the City Manager request the City Attorney <br />to prepare a deed from Milton B. Rogers to the City of San Marcos <br />for right-of-way on both sides of Linda Drive, Blk. 9, and that the <br />instrument include an agreement that the City will pave Linda Drive <br />one time, exclusive of curb and gutter, without cost to the property- <br />owner. Mr. Dannelley seconded the motion and on roll call, the <br />following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Craddock, Contreras, Dannelley, Flores, Serur <br />None <br /> <br />The Mayor declared the motion carried. <br /> <br />Mr. Contreras proposed ~ose Rodriguez as Presiding Judge for <br />Precinct 12 for the City Officers' Election, April 7. The appoint- <br />ment was made by the Mayor, with common consent of the Council. <br /> <br />Councilman Flores opened for discussion amendment of the Charter <br />to provide that the Mayor be elected to the position by the voters <br />
