A-6 - Require~ents <br />of Allocation Order DHUD <br /> <br />Dear Jim: <br /> <br />I <br /> <br />I have reviewed the memorandum to w. W. Collins, <br />Regional Administrator, from Lawrence M. Cox, Assis- <br />tant Secretary of HUD, concerning the approval of an <br />Allocation Order for the above Project. The approval <br />was based upon the fulfillment of certain pre-contract <br />conditions. <br /> <br />I <br /> <br />Among the conditions that must be satisfied are that <br />the Urban Renewal Agency submit an Affidavit of <br />Publication of the Notice of Public Hearing for the <br />area comprising Tex.R-llS, including 173.46 acres. <br />This public hearing must be conducted and the plan <br />locally approved within 90 days of the Allocation <br />Order, which was March 2, 1970. Since there has not <br />been a technical compliance of this requirement of <br />the Allocation Order, it is my opinion that the City <br />Council of the City of San Marcos must hold a valid <br />public hearing after due notice pursuant to the Texas <br />Urban Renewal Law, that is after the notice of the <br />hearing has been given by publication three times in <br />a newspaper having a general circulation in the City, <br />the first of which notices must be published at least <br />30 days prior to the hearing, Such notice should <br />describe the time, date, place and purpose of the <br />hearing and generally identify the urban renewal area <br />and outline the general scope of the urban renewal <br />project under consideration. <br /> <br />! -10 <br />
