A-6 - Require~ents of Allocation Order DHUD Dear Jim: I I have reviewed the memorandum to w. W. Collins, Regional Administrator, from Lawrence M. Cox, Assis- tant Secretary of HUD, concerning the approval of an Allocation Order for the above Project. The approval was based upon the fulfillment of certain pre-contract conditions. I Among the conditions that must be satisfied are that the Urban Renewal Agency submit an Affidavit of Publication of the Notice of Public Hearing for the area comprising Tex.R-llS, including 173.46 acres. This public hearing must be conducted and the plan locally approved within 90 days of the Allocation Order, which was March 2, 1970. Since there has not been a technical compliance of this requirement of the Allocation Order, it is my opinion that the City Council of the City of San Marcos must hold a valid public hearing after due notice pursuant to the Texas Urban Renewal Law, that is after the notice of the hearing has been given by publication three times in a newspaper having a general circulation in the City, the first of which notices must be published at least 30 days prior to the hearing, Such notice should describe the time, date, place and purpose of the hearing and generally identify the urban renewal area and outline the general scope of the urban renewal project under consideration. ! -10
