<br />n~:' <br />/ ;1-"' <br /> <br />AN ORDINANCE ESTABLISHING THE MINIMUM DISTANCE <br />FROM A CHURCH, A PUBLIC SCHOOL, OR A PUBLIC <br />HOSPITAL FOR THE SALE OF ALCOHOLIC BEVERAGES; <br />AND DECLARING AN EMERGENCY <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN MARCOS, TEXAS: <br /> <br />1. No person shall sell, or engage in the business of selling, <br /> <br />any alcoholic beverages where the place of business is located <br /> <br />within three hundred (300) feet of any church, public school <br /> <br />or public hospital, the measurements to be along the property <br /> <br />lines of street fronts and from front door to front door and in <br /> <br />a direct line across the street intersections where they occur; <br /> <br />\ <br />provided, however, that, this section shall not apply to any place <br /> <br />of business legally selling alcoholic beverages at the same location <br /> <br />I <br /> <br />for a continuous period of one (1) year next preceding the estab- <br /> <br />lishment, construction or purchase of property for the establish- <br /> <br />ment or construction of a church, public school or public hospital. <br /> <br />2.
