<br />A RESOLUTION
<br />
<br />OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, APPROVING THE FILING OF
<br />AN APPLICATION FOR UNDERTAKING OF SURVEYS
<br />AND PLANS FOR A DISASTER PROJECT.
<br />
<br />WHEREAS, under Title I of the Housing Act of 1949, as
<br />amended, the Secretary of Housing and Urban Development is
<br />authorized to extend financial assistance to a locality for
<br />the planning and undertaking of an Urban Renewal Project in
<br />an urban area which the governing body of the locality certifies,
<br />and the Secretary finds, is in need of redevelopment or
<br />rehabilitation as a result of a catastrophe which the President
<br />has determined to be a major disaster; and
<br />
<br />WHEREAS, it is desirable and in the public interest that
<br />the Urban Renewal Agency of San Marcos, Texas, prepare surveys
<br />and plans, presently estimated to cost approximately Five Hundred
<br />Twenty-Eight Thousand Seven Hundred Fifty-Six and No/IOO Dollars
<br />($528,.756.00), in order to undertake and carry out an Urban
<br />Renewal Project of the character contemplated by Section 111 of
<br />Title I, in that certain area, proposed as an Urban Rewewal
<br />Area, situated in the City of San Marcos, County of Hays, and
<br />State of Texas, and described on Exhibit "A" hereof;

<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS:
<br />
<br />1. That the proposed Urban Renewal Area described on
<br />Exhibit "A" is an urban area in need of redevelopment or
<br />rehabilitation as a result of a casastrophe which the President,
<br />pursuant to the provisions of Public Law 875, 81st Congress,
<br />as amended, has determined to be a major disaster, and is
<br />appropriate for an Urban Renewal Project; that the undertaking
<br />by the Urban Renewal Agency of San Marcos, Texas, of surveys
<br />and plans for an Urban Renewal Project of the character
<br />contemplated by Section 111 of Title I of the Housing Act of
<br />1949, as amended, in the proposed Urban Renewal Area described
<br />above, is hereby approved; and that financial assistance under
<br />Title I is needed to enable the Urban Renewal Agency of San
<br />Marcos, Texas, to finance the undertaking of the Project.

<br />2. That it is cognizant of the conditions that are imposed
<br />in the undertaking and carrying out with Federal financial
<br />assistance of an Urban Renewal Project of the character
<br />contemplated by Section 111 of Title I, including those
<br />prohibiting discrimination because of race, color, creed, or
<br />national origin; and also the following requirements: (a) that
<br />the contract for temporary loan or capital grant for the Project
<br />shall specify a date for compliance with the Workable Program
<br />for Community Improvement requirements of Section 101(c) of
<br />Title I; (b) that the Urban Renewal Plan shall be approved by
<br />this body; (c) that local grants-in-aid, consisting of donations
<br />of cash, land, demolition or removal work, and the installation,
<br />construction, or reconstruction of streets, utilities, parks,
<br />playgrounds, or other improvements or the provision of other
<br />public building or facilities, necessary for carrying out in
<br />the Urban Renewal Area the objectives of the Urban Renewal
<br />Plan, shall be provided in an amount which, together with the
