Mr. Dawson reemphasized the fact that problems encountered by the Flood Control District in acquiring necessary right-of-way for the retarding structures have delayed the planning process for those structures. Dr. Craddock moved to authorize EyrnfForest and Cotton to proceed with planning for their proposed Willow Creek channel improvement project presented as "Alternate E", consisting of earth channel and grassing slopes, concrete pilot channel, utility relocations, and road crossing improvements, with construction cost estimates of between $167,000 and $240,000. Mr. Flores seconded the motion, which passed unanimously. Mr. Porter noted that the plans would again be presented to the Council at the 60% stage of development for further approval. I Mayor Craddock next introduced for consideration plans for the Broadway Street Improvement project. Mr. Derrick reviewed the proposals submitted by Byrn/ Forrest and Cotton. Councilman Breihan recommended the Council reconsider its authorization to plan for Broadway Street to be constructed at a sixty foot width, face to face, and constructed instead at forty-four feet. Mr. Flores objected, pointing out that Broadway Street could easily become a major thorough- fare, and moved the Council authorize planning of a sixty foot street with "Alternate B" drainage improvements at an estimated construction cost of $491,000. Mr. Hansen seconded the motion. On roll call, the following vote was recorded: AYE: Arredondo, Flores, Hansen, Sutton NAY: Breihan, Dibrell, Craddock. At 9:00 p.m. Mr. Hansen moved the Council recess to Executive Session to discuss pending litigation and proposed acquisition of real property. Mr. Breihan seconded the motion, which passed unanimously. At 9:30 p.m. Mr, Hansen moved the Council reconvene in Special Session. Mr. Breihan seconded the motion, which passed unanimously. Mr. Flores moved to authorize the City Attorney to take action necessary to resolve and settle the recently filed suit styled "Homer Hamilton vs. City of San Marcos". Mr. ,Hansen seconded the motion, which passed unanimously. Mr. Hansen moved to authorize the City Attorney to purchase right-of-way on I L.B.J. Drive at Chestnut Street for an amount not to exceed $20,000 and to secure in return all legal documents necessary to close and complete the purchase. Mr. Breihan seconded the motion. On roll call, the following vote was recorded: AYE: Arredondo, Breihan, Dibrell, Craddock, Flores, Hansen NAY: Sutton.
