<br />104 <br /> <br />regular meeting, september 8, 1975 <br /> <br />page four <br /> <br />The Mayor read the caption of an Ordinanee as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS REPEALING ARTICLE 2 ENTITLED <br />"ITINERANT MERCHANTS AND VENDORS" OF CHAPTER 19 ENTITLED "PEDDLERS, <br />SOLICITORS AND ITINERANT MERCHANTS AND VENDORS" AND ENACTING IN ITS <br />PLACE A NEW ARTICLE 2 OF CHAPTER 19 DEFINING AND REGULATING ITINERANT <br />MERCHANTS, ITINERANT VENDORS, PEDDLERS, AND PERSONS SELLING OR TAKING <br />ORDERS FOR GOODS, WARES, MERCHANDISE, SERVICES, PHOTOGRAPHS, OR ADVER- <br />TISING IN PERSON; PROVIDING FOR A LICENSE FEE; REQUIRING SUCH PERSONS <br />TO REGISTER WITH THE TAX ASSESSOR-COLLECTOR; PROVIDING PENALTIES FOR <br />THE VIOLATION OF THIS ORDINANCE, INCLUDING A FINE NOT LESS THAN $50 <br />NOR MORE THAN $200; PROVIDING FOR A SAVING CLAUSE; AND REPEALING ALL <br />ORDINANCES IN CONFLICT THEREWITH AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Sutton moved approval of the Ordinanee on first reading. Mr. Hansen <br />seeonded the motion. The Mayor questioned the advisability of making no <br />provision in the ordinanee for denial of a request for permit. The City Attorney <br />replied that the scope of the ordinanee was limited to identifying solicitors <br />as opposed to approving them. Questioned by Bob Barton, Mr. Akins explained that <br />persons participating in a door-to-door voter registration drive would have to <br />be registered as solicitors. Mr. Broussard stated his opinion that the ordinance <br />would not alleviate the problems experienced by citizens of the eity and would <br />impose an undue burden on them. Mr. Flores moved the ordinance be tabled for <br />further study. Mr. Hansen seconded the motion. On roll call, the following vote <br />was recorded: <br /> <br />AYE: Craddock, Flores, Hansen, Sutton, Arredondo, Breihan <br />NAY: Dibrell. <br /> <br />The Mayor deelared the motion passed. <br /> <br />The Mayor read the caption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPOINTING SERGEANTS KARON GUENTHER AND OGDEN COLEMAN OF THE SAN <br />MARCOS POLICE DEPARTMENT ASSISTANT MUNICIPAL COURT CLERKS. <br /> <br />I <br /> <br />Mr. Sutton moved approval of the Resolution. Mr. Hansen secpnded the motion, <br />which passed unanimously. <br /> <br />The Mayor read the eaption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AND ACCEPTING THE COMPLETION OF CONSTRUCTION OF THE L.B.J. <br />DRIVE PAVING PROGRAM, PHASE 1. <br /> <br />Mr. Sutton moved approval of the Resolution. Mr. Flores seconded the motion. <br />The City Manager stated that the final construction cost, excluding acquisition <br />of right-of-way, was $110,525.66. On roll call, the motion passed unanimously. <br /> <br />The Mayor introdueed for consideration a Resolution accepting the provisions <br />contained in Minute Order Number 70303 passed by the State Highway Commission <br />on August 1, 1975, for the improvement by the Texas Highway Department of signal- <br />ization on Loop 82 at Sessom Drive and Colorado Street and on Ranch Road 12 at <br />C.M. Allen Parkway. Mr. Hansen moved approval of the Resolution. Mr. Flores <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introdueed for consideration a Resolution accepting the provisions <br />contained in Minute, Order Number 70304 passed by the State Highway Commission <br />on August 1, 1975, for the improvement by the Texas Highway Department of recon- <br />struction on Hazelton Street from Girard Street, southwest to Bishop Street, a I <br />distance of approximately 0.4 mile. Mr. Sutton moved approval of the Resolution. <br />Mr. Hansen seconded the motion, which passed unanimously. <br /> <br />The Mayor read the eaption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RESTRICTIVE COVENANTS TO BE PLACED ON THE COCK HOUSE <br />PROPERTY AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME IN BEHALF OF <br />THE CITY. <br /> <br />Mr. Breihan moved approval of the Resolution. Mr. Flores seconded the motion. <br />
