<br />-3- <br /> <br />agents or employees and said insurance shall be in a minimum <br />amount for one hundred thousand ($100,000.00) for anyone <br />person, and three hundred thousand ($300,000.00) for each <br />occurrence; and one hundred-thousand ($lOO~OOO.OO) for property <br />damage; and such insurance policy shall contain the endorsement <br />that such insurance may not be cancelled or amended with respect <br />to League without ten (10) days written notice by registered mail <br /> <br /> <br />to City by the insurance company. Any insurance policy herein <br /> <br />required or procured by League shall contain an express waiver of <br /> <br /> <br />any rights of subrogation by the insurance company against City. <br /> <br />The original policy of all such insurance shall be delivered by <br /> <br /> <br />League to Ci ty wi thin ten (10) days of the inception of such <br /> <br /> <br />policy by the insurance company. The minimum limits of any <br /> <br />insurance required herein shall not limit LeaguèB liability under <br /> <br /> <br />Part X of this Agreement. <br /> <br />X. <br />League shall indemnify, save and hold harmless City and all <br />officers, agents and employees of City from any and all damages, <br />claims, losses, demands, suits, judgments, costs and expenses <br />arising from the construction by League of a baseball complex at <br /> <br />said Park and the use by League of said complex pursuant to the <br /> <br />terms of this agreement including reasonable attorneys' fees <br /> <br />whenever said damages, claims, losses, demands, suits, judgments, <br /> <br /> <br />costs or expenses are caused in whole or in part by any negligent <br /> <br />act or omission of League, anyone directly or indirectly employed <br /> <br />by League or anyone for whose acts League may be liable, regardless <br /> <br /> <br />of whether said damages, claims, losses, demands, suits, judgments, <br /> <br />costs or expenses are caused in part by City. <br /> <br />XI. <br />City must give written approval for the operation of any <br />concession in said complex during use by League. Any agreement <br />between League and any concessionaire pertaining to liability on <br />account of any act or omission of the concessionaire of its <br />agents shall be filed with City. Written approval for the <br /> <br /> <br />operation of a concession during use of said complex by League <br /> <br /> <br />shall not be given by City until there is on file with City an <br />
